Independent Prison Monitoring Board (IPMB): Appointment of Member

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister decided to appoint Mr. T. De Prey as a Member of the Independent Prison Monitoring Board, for a term of 4 years, from 23 May 2022.

Reason for Decision(s):

The Prison (Independent Monitoring Board) Regulations 2017 (‘the Regulations’) provide that the Minister must appoint the members of the Monitoring Board.

Resource Implications: None as a result of this decision, Board Members serve in an honorary capacity.

 

Action Required: Mr De Prey to be advised of appointment.

Independent Prison Monitoring Board (IPMB): Appointment of Member

REPORT: Appointments to the Independent Prison Monitoring Board

Background

The Independent Prison Monitoring Board was established in April 2017 according to The Prison (Independent Monitoring Board) Regulations (‘The regulations’).

The Regulations provide that the Board must satisfy itself of:

(a)     the treatment and welfare of the prisoners;

(b)     the state of the premises of the prison; and

(c)     the administration of the prison.

In 2021 the Board carried out 22 Monitoring Visits to HMP La Moye and looked into 51 applications made by Prisoners at HMP La Moye.

The IPMB provides a vital safeguard to ensure the correct treatment of people detained at HMP La Moye and is a central feature of the island’s move towards demonstrating compliance with the UN Optional Protocol to the Convention Against Torture (OPCAT) requirements.

The regulations provide that the Minister must appoint the members of the Monitoring Board and must appoint from the membership of the Monitoring Board a chairman and a deputy chairman.

Recruitment of new Members

Further to vacancies arising on the Board, a recruitment campaign was undertaken in June 2021 to seek new members in accordance with Government of Jersey recruitment guidelines. This included a press release and drop in sessions at the library.  

Further to this, it is recommended that the Minister appoint the following individual as Member of the Board:

  • Thomas De Prey

The term of appointment is for 4 years, from 23 May 2022.
