Sports Facilities Strategy Policy Development Board: Establishment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The Chief Minister approved the appended terms of reference for a new Policy Development Board (PDB) to oversee development of a new Sports Facilities Strategy. The Chief Minister was satisfied that a new Sports Facilities Strategy for the Island was required and that a PDB was the appropriate mechanism to oversee development of the same.

  1. Purpose

 

1.1.        To provide political oversight of the development of a sports facilities strategy for the Island. These proposals are to be considered for incorporation in, and delivery via, the Government Plan, the Island Plan 2021-2030, and other delivery strategies as appropriate.

 

 

  1. Background and rationale

 

2.1.        The Council of Ministers’ Statement of Common Strategic Policy 2018–2022 (CSP) includes the priority ‘We will improve Islanders’ wellbeing and mental and physical health.’  The priority calls upon government to ‘strive to create the conditions that enable all Islanders to lead active, healthy lifestyles to support their physical and mental wellbeing.’

 2.2.        In 2017 the then Economic Development, Tourism, Sport and Culture Department commissioned consultants Knight, Kavanagh and Page (KKP) to produce a Sports Facilities Delivery Report.  The report, published in Q4 2018, considered future need on the Island in respect of its indoor and outdoor sports provision plus service improvement and development.

 2.3. The KKP report partially identifies the broad range of sports and sporting activity that Island residents take part in (see:  https://www.gov.je/SiteCollectionDocuments/Government%20and%20administration/R%20Sports%20Facility%20Delivery%20Report%2022012019KLB.pdf)

2.4 The sports facilities strategy will have an extended reach to incorporate the full range of sporting activities contributing to improved health and wellbeing. 

 

 

  1. Roles and responsibilities of the Board

 

3.1.        The Board shall: 

  • provide political strategic direction
  • examine issues relating to the supply of and demand for sports facilities across all sports, with reference to access, affordability and quality
  • consider evidence from a broad cross-section of stakeholders
  • learn from approaches adopted in other jurisdictions
  • oversee the development of a sports facilities strategy encompassing all sports, across the Island.

  1. Timetable

The Board shall meet every two months or more frequently if required.  

 

  1. Records and reporting

 

6.1.        Minutes of meetings will be taken to ensure that a proper official record is maintained.  Minutes will be published as soon as practical and appropriate.

 

6.2.        The findings of the Board will be drafted into a report and, following approval by the Chair, provided to the Chief Minister and the responsible Ministers. The dissent of any member will be noted where requested. The findings will also be provided to the Council of Ministers, following which the report will be published as soon as practical and appropriate.
