Budget transfer from Restructuring Provision to Department of the Environment to fund Digitally Integrated Planning Process

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister approved a non-recurring budget transfer of £171,370 in 2016 from the Restructuring Provision to the Department of the Environment Equipment, Maintenance and Minor Capital head of expenditure (I00MF14015) to fund the Digitally Integrated Planning Process within the Public Sector Reform Programme.

Reason(s) for Decision:   Under Article 17(2) of the Public Finances (Jersey) Law 2005, the Minister for Treasury and Resources is authorised to approve the transfer from contingency expenditure or the insurance fund of amounts not exceeding, in total, the amount available for contingency expenditure in a financial year.

 

This funding will enable the Digitally Integrated Planning Process to proceed, allowing the Department to continue its work in modernising the planning process in Jersey, benefiting the public and facilitating the savings proposed for the department in relation to digitising the planning approvals system.

 

A decision (MD- PE-2016-0116) was signed by the Minister for the Environment on 22nd August 2016. 

Resource Implications: The Department of the Environment Equipment, Maintenance and Minor Capital head of expenditure (I00MF14015) will increase by £171,370 in 2016 and the Restructuring Provision element of contingency will decrease by the same amount.  This decision does not change the total amount of expenditure approved by the States for 2016 in the Medium Term Financial Plan.

Action required: Head of Decision Support to advise the Finance Manager – Department for the Environment once this decision has been approved.

Restructuring Provision Bid – DIGITALLY INTEGRATED PLANNING PROCESS

 

 

 

  1. Purpose of Report

To enable the Minister to approve a budget transfer totalling £171,370 in 2016 from the Restructuring Provision to the Department of the Environment Equipment, Maintenance and Minor Capital head of expenditure (I00MF14015). The funding was agreed by the Council of Ministers on 6th July 2016 in support of the Public Sector Reform Programme.

 

 

  1. Background

The Contingency Allocation Policy published by the Minister for Treasury and Resources (R.10/2012) states that all requests for Allocation from Contingency will be considered by the Council of Ministers.

 

On the 6th July 2016 the Council of Ministers considered a report outlining the funding requirements in 2016 for the Digitally Integrated Planning Process within the Public Sector Reform Programme together with funding for the complete Public Sector Reform Programme. The Council of Ministers agreed funding as proposed for 2016 totalling £171,370.

 

 

3. Recommendation

The Minister is recommended to approve a budget transfer totalling £171,370 in 2016 from the Restructuring Provision element of contingency to the Department of the Environment Equipment, Maintenance and Minor Capital head of expenditure (I00MF14015) in support of the Public Sector Reform Programme – specifically the Digitally Integrated Planning Process.
