Sea Fisheries (Inshore Trawling, Netting and Dredging) (Jersey) Regulations 2001: Amendment: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Purpose of the Report

 

For the Minister to request law drafting time to make an amendment to Sea Fisheries (Inshore Trawling, Netting and Dredging)(Jersey) Regulations 2001
 

Background

 

In June 2016 the States of Jersey approved an amendment to the Sea Fisheries (Inshore Trawling, Netting and Dredging)(Jersey) Regulations 2001 in order to limit the length of net that could be set on the beach to 100 metres. A further amendment to these regulations was approved in November 2016 to allow the Minister to set the length of net by Order. Subsequent to this amendment, upon receipt of further advice, another amendment is required to allow for the length of net to be set at zero (0).     

 

Details
 

The most recent scientific advice on the bass stock published by the International Council for Exploration of the Sea (ICES) on the 30th June 2016 stated the recommendation for catches of bass for 2017 was a reduction for both the commercial and recreational sectors to zero. Given this, it is vital that the Minister has the necessary legislative tools at their disposal to ensure the most appropriate stock management measures can be employed in a timely and simple way.  

It is acknowledged that, although nets can and do catch other species, the target stock is bass. It is somewhat nonsensical to be able, through other regulations currently in place, to restrict the amount of bass that can be caught, but to continue to allow a fishing method to continue that targets this species.

The current Regulations and Order allow the Minister to prescribe the length of net that an individual can set but does not allow for that number to be zero (0). This amendment will allow for the length of net to be set at zero (0). 

The proposed amendment will allow the Minister by Order to prescribe the times and location that a beach net can be set therefore prohibiting the setting of beach nets should the stock status require that prohibition.
