La Route Orange, St. Brelade: Pedestrian Refuge: Installation outside Waitrose

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

TRANSPORT AND TECHNICAL SERVICES

 

INSTALLATION OF PEDESTRIAN REFUGE ON LA ROUTE ORANGE

 

(HIGHWAY ENCROACHMENTS JERSEY REGULATIONS 1957)

 

 

Purpose of the Report

 

To outline the requirement for a safer and more convenient location for crossing to be located between the car park (accessed by car off La Route des Quennevais) and the Waitrose Store in St Brelade.

 

 

Background

 

At peak times the existing Waitrose car park is insufficient to cope with the volume of traffic it experiences and this has an effect on La Route Orange in St Brelade. Representatives of Waitrose have approached Transport and Technical Services regarding the installation of a pedestrian refuge.

 

Plans to install a refuge on La Route Orange align with MD-PH-2014-0198 which permits Waitrose to lease part of the car park at St Brelade from Jersey Property Holdings. 

 

As a result of the previous MD, it is likely that an increase in pedestrians attempting to cross the road from the car park to the Waitrose Store will occur. The new pedestrian refuge will be placed on the most convenient location to cross the road between the car park pedestrian access and the supermarket to facilitate safe access.

 

It is anticipated that a planning application will be required for the proposed ramp at the pedestrian access to the car park to La Route Orange, to account for the different levels between the car park and the road. The car park is approximately 1.5m higher than the adjacent footway on La Route Orange.

 

Waitrose has agreed to fund the cost of the new refuge.

 

 

Discussion

 

A traffic impact analysis of the effect of the refuge has been undertaken by Waitrose’s Consultant with respect to the operation of the nearby signalised junction where La Route Orange meets La Route des Quennevais. The assessment concludes that the refuge will have no significant impact on traffic flows or nearby junction capacity. This has been independently verified by TTS.

 

 

Recommendations

 

Under the Highways Encroachments Jersey Regulations 1957, TTS has consulted the Connétable of St Brelade, who is supportive of the scheme and has recommended proceeding with the installation of the refuge.

 

The Minister is recommended to approve the installation of the pedestrian refuge and instruct TTS Officers to liaise with Waitrose regarding the detailed design and funding agreement for the installation of the refuge.
