Driver and Vehicle Standards - fees 2010

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

AND MISCELLANEOUS PROVISIONS) (JERSEY) ORDER 2009  
 

Purpose of the Report  

To consider the Transport and Technical Services (Driver and Vehicle Standards – 2010 Fees and Miscellaneous Provisions) Jersey) Order 2009. 

Part 1 of the Order increases, by approximately 2.5%, fees connected with – 

(a) an application for a badge to drive a public service vehicle; 

(b) registration of a motor vehicle, changes of registration mark, issue of trade licences and issue of certificates in respect of vehicle standards; 

(c) registration of driving instructors; 

(d) licensing of a vehicle that does not comply with construction and use requirements; 

(e) driving tests. 

The increases take effect from 01 January 2010. Fees were last increased on 01 January 2009. 

Part 2 of the Order –  

  1. introduces type approval requirements for registration of agricultural tractors;

 

  1. adds to the categories of Italian driving permits in replacement for which a Jersey driving licence may be issued;

 

  1. removes Quebec from the list of jurisdictions with whom Jersey exchanges driving licences.

 

These amendments commence on 01 January 2010. 
 

Background 

On the basis of Ministerial Decision MD-T-2009-0092, it was decided to increase most fees for services provided by Driver and Vehicle Standards by approximately 2.5%, in line with States Policy. 

In addition to the DVS fees increases there is one housekeeping amendment to the Motor Vehicles (General Provisions) (Jersey) Order 1993 which introduces type approval requirements for registration of agricultural trailers. 
 

There are also two housekeeping amendments to the Motor Vehicles (Driving Licences) (Jersey) Order 2003 to:- 

  1. add categories C1 and D1 to the categories of Italian driving permits in replacement for which a Jersey driving licence may be issued.
  2. remove Quebec from the list of countries with whom Jersey exchanges driving licences.

 
 

Discussion 

The Law Draftsman was asked to prepare the necessary changes to the Order on the basis of a brief provided by the department. 

The Transport and Technical Services (Driver and Vehicle Standards – 2010 Fees and Miscellaneous Provisions) (Jersey) Order 2009 is attached for the Minister to make the Order.  Making the Order will implement the increase in charges.  It will also: 

  1. introduce type approval requirements for registering agricultural tractors – mandatory in the E.U. since 2005;
  2. add Italian C1 and D1 driving licence categories to those already accepted for driving licence exchange;
  3. remove Quebec from the list of jurisdictions with whom Jersey exchanges driving licences. For several years DVS has tried to finalise an exchange agreement without result.

 
 

Recommendation 

The Minister is recommended to make the Transport and Technical Services (Driver and Vehicle Standards – 2010 Fees and Miscellaneous Provisions) (Jersey) Order 2009 and request the department to take the necessary action to implement the Order. 
 

Reason(s) for Decision 

To make the Transport and Technical Services (Driver and Vehicle Standards – 2010 Fees and Miscellaneous Provisions) (Jersey) Order 2009, to allow an increase in fees in line with States policy and implement the housekeeping legislative amendments. 
 

Action Required 

To notify the Greffier of the States and the Law Draftsman that the Order has been made and to forward the signed and sealed Order to the Publications Editor, States Greffe, for notification to the States.
