Amendment to Road Traffic (St. Martin) (Jersey) Order 1989

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Amendment to Road Traffic (St. Martin) (Jersey) Order 1989

TRANSPORT AND TECHNICAL SERVICES

ROAD TRAFFIC (ST MARTIN) (JERSEY) ORDER 1989 - AMENDMENTS

Purpose of the Report

To improve the existing parking arrangements on certain sections of road in the Gorey Harbour area, and to prohibit waiting on La Rue de la Croix au Mâitre in front of the school and a small section of La Rue des Raisies near the Public Hall, now that the new public car park has been completed.

Background

At its meeting on the 15th August 2005, the Environment and Public Services Committee approved the above Parish request with regard to the parking improvements in the Gorey Harbour area, and instructed the Law Draftsman to draft the necessary Order Amendment.

The Committee had also previously approved the prohibition of waiting on sections of La Rue de la Croix au Mâitre and La Rue des Raisies near the Public Hall, temporarily, for a period not exceeding twelve months under Article 68 of the Road Traffic (Jersey) Law 1956.

Discussion

The Minister is requested to approve the attached Draft Road Traffic (St Martin) (Amendment No 8) (Jersey) Order 2006, with regard to the above items, to be included in the Road Traffic (St Martin) (Jersey) Order 1989.

Recommendation

The Minister is requested to approve the Amendment to be effective from the 20th of March 2006.

To introduce parking improvements in the Gorey Harbour area and prohibit waiting on sections of La Rue de la Croix au Mâitre and La Rue des Raises.

Action Required

The Minister to instruct his officers to process the Ministerial decision.
