Land exchange - Le Squez, St. Clement

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

To agree the transfer of land between the Public and Samares Nurseries Properties Limited

Decision(s):

The Minister:-

  1. rescinded MD-H-2010-0003.
  2. agreed the proposed transfer of land between the parties as shown on drawing number M843/01, and as set out in the report, subject to the Public meeting all the reasonable legal costs,
  3. requested that the Treasury & Resources Minister approve the transaction under Standing Order 168(2)(a) and that following notification to the States in accordance with Standing Order 168(3) to authorise the Greffier and Attorney General to sign the necessary contracts on behalf of the Public.

To ensure that the sale is carried out in accordance with Standing Order 168

REPORT TO THE HOUSING MINISTER  

TRANSFER OF LAND AT SAMARES NURSERIES

TO FORM NEW BOUNDARY LINE  

Background

On 13th January 2010, the Assistant Minister for Housing approved a proposal to establish a new boundary line between the Public’s land at Le Squez and Samares Nurseries owned by Samares Nurseries Properties Limited, (MD-H-2010-0003 refers)

It was agreed that the Public would meet the other party’s reasonable legal costs, which at that time had been estimated at £1,500.00.  Reaching final agreement on the land exchange and the terms of the necessary contract has been a protracted affair and the costs incurred by the other party have exceeded that initial estimate and now amount to £2,317.50.

Recommendations  

That the Minister; 

  1. Rescind MD-H-2010-0003.

 

  1. Approve the proposal to the transfer of land between the parties to facilitate the establishment of the new boundary, subject to Public meeting all the reasonable legal costs,

 

  1. Request that the Treasury & Resources Minister approve the transaction under Standing Order 168(2)(a) and that following notification to the States in accordance with Standing Order 168(3) to authorise the Greffier and Attorney General to sign the necessary contracts on behalf of the Public.
