Road Traffic (Trinity) (Jersey) Order: Proposed amendment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

ROAD TRAFFIC (TRINITY) (JERSEY) ORDER 1988

 

 

Purpose of the Report

 

To amend the Road Traffic (Trinity) (Jersey) Order 1988.

 

 

Background

 

The Connétable of Trinity has requested the Minister to amend the Parish Traffic Order to introduce:

 

  1. A width restriction in La Rue du Gres
  2. Prohibited waiting on part of La Rue du Pont
  3. An extension to the existing prohibited waiting on Le Mont de Rozel.
  4. Minor changes to prohibited waiting sections on La Route de la Trinite

 

 

Discussion

 

  1. La Rue du Gres is unsuitable for use by large vehicles due to its narrow width and sharp bends. It is therefore proposed to prohibit its use by these vehicles, some of whose drivers are increasingly in the habit of attempting to use the road as a short cut – please see attached Plan 1.

 

  1. Cars perpetually park on the south section of La Rue du Pont, where it approaches La Route d’ Ebenezer.  This leads to difficulty for other road users attempting to pass each other. It is also impossible to clean the road, and access for emergency services is difficult.  The Connétable therefore wishes to prohibit waiting on both sides from La Route d’Ebenezer for a distance of 153 yards in a northerly direction – please see attached Plan 2.

 

  1. In 2015 parking was prohibited by Order along part of Le Mont de Rozel.  This has benefited traffic flow up and down the hill. However, by introducing this restriction parking was displaced to the bend in the road, which is now causing its own difficulties. The Connétable therefore wishes to extend the prohibited waiting further up the hill to protect the bend – please see attached Plan 3.

 

  1. A review of road markings on La Route de la Trinite was carried out as part of the preparations for re-surfacing of the road.  This has resulted in minor revisions to prohibited waiting sections being agreed with the Connétable.

 

The proposals are supported by the Parish Roads Committee.

 

 

 

 

 

Recommendation

 

The Minister is recommended to approve the proposed amendments to the Traffic Order.
