A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

ALTERNATIVE CHARGING SYSTEMS IN CAR PARKS

 

 

Purpose of the report

 

To request the Minister to approve Law Drafting instructions to allow the introduction of an alternative charging systems to run alongside the existing paycard and Automatic Number Plate Recognition system which operates in Sand Street Car Park. The Minister is requested to approve instructions being given to the Law Draftsman to make the necessary Amendment to the Road Traffic (Public Parking Places) (Jersey) Order 2006, the Road Traffic (Sand Street Car Park) (Jersey) Order 2012 and the Road Traffic (Public Parking Places – Charges) (Jersey) Order 2010 to enable the introduction of alternative charging systems to run alongside the current approved schemes.

 

 

Discussion

 

The current system of paycards to pay for parking in both car parks and on street locations has been used in Jersey for a number of years.  Although alternative systems have been considered in the past it had been difficult to identify a system which would be suitable to fully replace paycards in both car park and on street locations. Recent improvements in technology mean a system which is based on mobile phone technology is a suitable solution and will meet the requirements of both car park and on street parking. Systems using this technology are becoming widely used throughout the UK and on the Continent.

 

A tender is currently being finalised to seek a suitable business partner who can provide this type of service to the States of Jersey and this will be introduced beginning with car parks operated by Transport and Technical Services Department to commence during 2015.

 

In order to enable the introduction of the new charging system it will be necessary to amend the Road Traffic (Public Parking Places) (Jersey) Order 2006, the Road Traffic (Sand Street Car Park) (Jersey) Order 2012 and the Road Traffic (Public Parking Places – Charges) (Jersey) Order 2010 to allow changes to the current charging and enforcement scheme.

 

The Road Traffic (Public Parking Places) (Jersey) Order 2006, the Road Traffic (Sand Street Car Park) (Jersey) Order 2012 and the Road Traffic (Public Parking Places – Charges) (Jersey) Order 2010 are all administered by Transport and Technical Services Department.

 

 

Recommendations

 

The Minister is recommended to approve the necessary changes to the relevant Orders in order to allow the introduction of a new charging system.
