The presentation of reports and accounts for the Jersey Council for Safety and Health at Work to the States.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Proposition P.102/1991 on the work of the Jersey Council for Safety and Health at Work requires that an annual report and accounts be prepared and presented to the States.

1. SUMMARY

The Minister is asked to consider and approve the reports and accounts for the Jersey Council for Safety and Health at Work. There are two separate sets of reports and accounts, the first for the 12 month period ending the 30th June 2005 and the second for the six month period ended the 31st December 2005. The preparation of the second set of report and accounts allows for the realignment of the Council’s financial year with the States financial year, from the 1st January to the 31st December each year.

The Minister is asked to agree to the presentation of the reports and accounts to the States, consider the funding request prepared by the Council for 2006 and acknowledge the work carried out by the Council.

2. BACKGROUND

2.1 The Jersey Council for Safety and Health at Work

The Jersey Council for Safety and Health at Work was established by the States in 1973 as an independent body to promote health and safety at work.

The Council consists of a Chairman, four members and one co-opted member all of whom have been recognised as having an interest in health and safety at work. The Council is assisted by a part-time secretary, the only paid employee of the Council, the Chairman and members serving in an honorary capacity. The Director of Health and Safety sits on the Council as an ex-officio member.

The Council is required to present an annual report to the States, through the Minister, which details its activities throughout the year together with an annual set of audited accounts.

2.2 Funding request for 2006

The Council’s work is funded by an annual grant given by the States which is administered by the Minister. The Council has prepared a budget forecast to support the request for the grant for 2006, which is included as Appendix D of their annual report for 2005.

The Council has requested a grant for 2006 of £30,000. This grant can be met by the budget figure which has already been included in the Health and Safety Inspectorate budget for 2006.

3. RECOMMENDATION

The Minister is asked to agree to both sets of reports and accounts being presented to the States and grant the Council’s funding request for 2006.
