Public Employees' Pension Scheme: Appointment of an Admitted Employer Representative

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision and reason for the decision

The Chief Minister on the recommendation of the Treasury and Resources Minister decided to appoint Professor Edward Sallis OBE to be appointed to the Public Employees’ Pension Scheme - Committee of Management as the Admitted Employer representative for a period not exceeding 5 years.

 

Members of the Public Employees Contributory Retirement Scheme (PECRS) Committee of Management (CoM) were previously appointed by the States Assembly for a period of three years on the recommendation of the Chief Minister. 

 

Following the implementation of the Public Employees Pension Scheme (PEPS) legislation effective 1st January 2016, members of the Committee must now be appointed by the Chief Minister on the recommendation of the Minister for Treasury and Resources for a period not exceeding 5 years (although the Chief Minister may extend the initial term of office for a second and final term of office). It is therefore, no longer a requirement for Committee members to be appointed by the States Assembly although this does remain a requirement for the Chairman of the Committee.

 

Under the PEPS legislation the Committee of Management must be comprised of:

 

(a)           A Chairman; and

 

(b)           12 members of the Committee (excluding the Chairman) divided into each of the following categories-

 

(i)             5 employer representatives;

(ii)           4 member representatives;

(iii)          2 pensioner representatives; and

(iv)          1 admitted employer representative.

 

The reference to “employer representatives” is taken to include the admitted employer representative, and a reference to “member representatives” is taken to include the pensioner representatives.

 

In the case of a proposed appointment in respect of an admitted employer representative, the Minister for Treasury and Resources may only recommend a person for appointment where that person has been nominated by an admitted employer, to apply for appointment as a member of the Committee

Resource implications

There are no resource implications for the States as a result of this decision.

Action required

Policy and research Officer – Chief Minister’s Department to inform the Projects Director – Pensions once this decision has been approved.

INTRODUCTION

It is therefore, no longer a requirement for Committee members to be appointed by the States Assembly although this does remain a requirement for the Chairman of the Committee. Appointments to the Committee, excepting the Chairman, are honorary appointments.

 

Under the legislation the recruitment of the Chairman and members of the Committee must be overseen by the Jersey Appointments Commission, and conducted in accordance with the guidelines produced by the Commission under Article 24 of the Employment of States of Jersey Employees (Jersey) Law 2005 as amended.

 

Under the PEPS legislation the Committee of Management must be comprised of:

BACKGROUND

 

Following the resignation of Mr Meeku Patidar a recruitment process was undertaken for a representative nominated by an admitted employer. A letter was sent to the larger admitted bodies within PEPS (see below) requesting nominations of a board member or senior employee for this vacancy on the CoM. One response was received, from Jersey Heritage, nominating Professor Edward Sallis OBE.

A recruitment process was carried out on 16th November 2016 in accordance with Appointment Commission Guidelines.  This resulted in the recommendation to appoint Mr. Sallis.

 

RECOMMENDATION

 

For the Chief Minister, on the recommendation of the Treasury and Resources Minister, to appoint Professor Edward Sallis OBE to the PEPS Committee of Management as the Admitted Employer representative for a period not exceeding 5 years.

 

A brief biography of Mr. Sallis is included below.

 

ADMITTED EMPLOYER NOMINEE

 

Professor Edward Sallis, OBE

 

Professor Sallis is Chair of the Board of Trustees of Jersey Heritage, which is an Admitted Body of PEPS.  He was Principal and Chief Executive of Highlands College from 1997 to 2012 and since his retirement he has held a number of consultancy and non-executive positions in Jersey and the UK.  

 

He is a Commissioner of the Jersey Appointments Commission and a non-executive director of a national charity the Education Support Partnership where he chairs the Audit and Risk Committee.

 

In 2015 he chaired the review of Maths and English qualifications available in technical education for the then Skills Minister, Nick Boles MP and is a member of the Education and Training Foundation’s Expert Panel on Professional Standards in Technical Education.  

 

Professor Sallis has authored a number of books and scholarly publications mainly in the field of educational management and leadership and is Visiting Professor in the Academic Partnerships Faculty of Plymouth University.  He holds a doctorate from the Bristol Business School and the Financial Times Non-Executive Director Diploma. He was appointed OBE in the 2010 New Years Honours List for his services to Education.
