Organic Farmers: Support Payment 2016

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: To provide support payment to organic farmers in Jersey for 2016 in recognition of the delay in the implementation of the new Rural Economy Strategy.

Decision(s): The Minister approved payments for organic growers and producers registered with a recognised organic certification body in 2016.

Reason(s) for Decision: The new Rural Economy Strategy, including the proposed Organic Action Plan, was due to be implemented in 2016 and in recognition in the delay in the implementation of the new Rural Economy Strategy, organic farmers and growers should receive a payment to cover membership fees of their organic certification body and an area payment in recognition of land in organic production.

Resource Implications: The expected cost of support is about £22,000 which includes organic processor licences, membership fees and the area of agricultural land under organic status. The administration of the proposed payment will be undertaken by officers of the Rural Economy Section at no additional cost.

Action required: A letter to be circulated to all organic producers in Jersey asking them to apply for the proposed support payment, accompanied by a receipted invoice for each farm’s 2016/17 organic fees and a field schedule showing the area of agricultural land under organic status.  On receipt of the above information payment will be requested from Treasury.

Purpose of the Report

 

The Minister for the Environment (The Minister) is requested to approve an interim payment to registered organic farmers in Jersey for 2016 in recognition of the delay in the implementation of the new Rural Economy Strategy.

 

Background

 

The new Rural Economy Strategy, references an Organic Action Plan designed to support organic farming, this was developed between the Jersey Organic Association – Producers Group and the SOJ Environment Department following on from the “Strategic review of Organic farming in Jersey” produced by Mark Measures.

 

Discussion

 

The Organic Action Plan forms part of the new Rural Economy Strategy publication of which has been delayed due to the MTFP negotiations and as a result of consultations with the farming industry and as such, will not be implemented until 2017.

 

Due to this delay, it is recognised that organic farmers and growers should receive a payment to cover membership fees of their organic certification body and an area payment in recognition of the environmental benefits of land in organic production.

 

The expected cost of the organic certification support together with the organic area support, will provide the organic sector with approximate £22,000 of exceptional support for 2016. This will be found within the current CES budget and will be conditional upon recipients taking a Jersey Business Health Check in 2017.  The administration of the proposed payment will be undertaken by officers of the Rural Economy section at no additional costs

 

Recommendation

 

  1. The Minister approves an interim payment to registered organic farmers and growers.

 

  1. The director of EMRE will write to all organic producers in Jersey asking them to apply for the proposed support payment, accompanied by a receipted invoice for each farm’s 2016/17 organic fees and a field schedule showing the area of agricultural land under organic status. 

 

  1. On receipt of the above information payment will be requested from Treasury.
