Road Traffic (Grouville) (Jersey) Order 2002: Amendment: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Reason(s) for Decision:  At the request of the Connétable of Grouville to change road side parking restrictions in the Parish to improve parking provision in New Road and to improve road access to Grouville School.

TRANSPORT AND TECHNICAL SERVICES

ROAD TRAFFIC (GROUVILLE) (JERSEY) ORDER 2002

 

Purpose of the Report

 

To amend the Road Traffic (Grouville) (Jersey) Order 2002 to introduce and to amend certain waiting restrictions.

 

 

Background

 

1)  The Connétable of Grouville has requested that a section of road side waiting               restriction in New Road, Gorey Village be removed.

 

2) In order to facilitate traffic flow and parking changes as part of improvements to vehicular access to Grouville School some road side waiting on La Rue de la Ville es Renauds is to be prohibited.

 

 

Discussion

 

1) The attached aerial photo shows the section of existing prohibited waiting on the north side of New Road (shown in black as “13 yards”) which the Connétable wishes to be removed.  Road side parking in the village is highly valued by residents and visitors. The removal of this section of yellow line will enable parking for two cars and will not cause disruption to passing road users.

 

2) Plans have been finalised for improving road user access to and from Grouville School. The plans include changing pick up and drop off facilities, on site parking and road side parking.  With regard to road side parking, the attached plan shows the section of La Rue de la Ville es Renauds where waiting is to be prohibited (where the road is too narrow to accommodate parking plus two way traffic) as part of the improvement plans.

 

The changes to road side parking will require amendments to Schedule 2 of the Road Traffic Order.

 

 

Recommendation

 

The Minister is recommended to approve the proposals.
