Great Union Road Surface Water Separation: Tender Report for Project No. 10624

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):  The Minister accepted Geomarine’s Tender for Project Number 10624 - Great Union Road Surface Water Separation in the sum of £197,855.14.

 

Reason(s) for Decision:  Geomarine have tendered the lowest Commercial bid and have met the minimum Technical requirements.  Funding is available from 2020 Capital Votes for this year’s project.

Resource Implications:  Resources have been allocated from GHE personnel.

 

Action required:  Officers to produce a Contract document for the Minister for Infrastructure and the Contractor to sign.

TENDER REPORT FOR PROJECT NUMBER 10624

 

GREAT UNION ROAD SURFACE WATER SEPARATION

 

(Exempt QE Article 33(b))

 

Purpose of the report

 

The purpose of this report is to recommend a contractor following the tender assessment of Project Number 10624 - Great Union Road Surface Water Separation.

 

 

Background

 

The Great Union Road Surface Water Separation Scheme is one of the projects identified in the GHE Liquid Waste Surface Water Separation Schemes Procurement Strategy.

 

The key benefits of Surface Water Separation are:

 

1)      Reduction in unnecessary flows being conveyed to and treated at Bellozanne Sewage Treatment Works (STW)

2)      Reduction in risk of Combined Sewer Overflow of dilute foul sewage to sea

3)      Increase potential capacity at STW for future foul sewer extensions

 

 

Tender Process

 

Two local Civil Engineering Contractors, with recent and relevant experience of this sort of construction, were requested to tender for this work. The pre-tender estimate for the construction was approximately £250,000.  It was felt that only two local civil engineering contractors had the relevant expertise and staff to undertake these works.

 

Tenders were requested via the Channel Island e-Portal; and were returned on 14 August 2020.

The tender Conditions of Contract were a modified version of the NEC3 Short Conditions. One of the Tenderers (Geomarine) offered alternative Conditions of Contract – the Standard NEC3 Short Conditions.

 

Technical Assessment

 

Both Tenderers provided excellent Technical bids.

 

Commercial Assessment

 

Geomarine provided the lowest commercial bid. The Bill of Quantities will enable a re-measure of the completed works to represent the work actually done.

 

 

Recommendations

 

Geomarine’s tender represents value for money and demonstrates a clear understanding of the project delivery requirements. The proposed alternative Conditions of Contract are a standard NEC3 Short Contract that has been used on similar recent tenderers. Experience of similar projects in an urban environment strongly indicate that there is a strong likelihood of re-design due to unforeseen utilities; accepting the alternative conditions will facilitate a more straightforward approach to the re-measure of varied and additional work.

 

 

Decision

 

To accept Geomarine Limited’s tender for the sum of £197,855.14 for Project No. 10624 - Great Union Road Surface Water Separation.

 

 

Reason for Decision

 

Geomarine have suitable experience, staff and resources and have provided a commercial offer that represents value for money.

 

Funding is available from 2020 Capital Votes.
