La Retraite, La Rue de la Retraite, St. Saviour - list as site of special interest

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister for Planning and Environment determined that La Retraite, La Rue de la Retraite, St Saviour be added to the List of Sites of Special Interest

Reason(s) for Decision:

1.     The special interest of the building and place referred to above, as defined and in the schedule and relative to the published criteria for selection, justifies its inclusion on the List of Sites of Special Interest in accordance with the provisions and purposes of the Planning and Building (Jersey) Law 2002 and;

2.     it accords with the States Strategic Plan commitment of protecting and sympathetically managing the Island’s built heritage assets.

Legal and Resource Implications:

Article 51(2)(b) of the Planning and Building (Jersey) Law 2002 enables the Minister to include on the List of Sites of Special Interest those buildings and places that the Minister is satisfied has public importance by reason of the special archaeological, architectural, artistic, historical, scientific or traditional interest that attached to the building or place.

Purpose of the Report

To seek to confirm the Minister’s intention to add La Retraite, La Rue de la Retraite, St Saviour to the List of Sites of Special Interest. 

Background and discussion

A report on this site, prepared by Jersey Heritage dated 20 January 2010 (at appendix 1), determined that this building and place was of sufficient interest to warrant its addition to the List of Sites of Special Interest. A notice of Minister’s intent to add this site to the List was served on the owner of the property in order to provide an opportunity for representations to be made. 

A representation was received on 29 March 2010 which, whilst not objecting to the principle of the proposed Listing, raised a number of reservations relating to the extent to which the interior of some of the buildings on the site were of interest. The representation received is attached at appendix 2. 

Jersey Heritage has reviewed the matter in light of the representation received and has prepared a supplementary report addressing the issues raised (dated 12 May 2010 and attached at appendix 3). 

In essence, Jersey Heritage maintains the view that the outbuildings are important to this farm group and that they are maintained in the proposed Listing of the site; and that the principal outbuilding does have particular internal interest. Other outbuildings have limited internal interest. The SSI schedule has been amended to highlight these particular matters.

Recommendation

On the basis of the recommendation of Jersey Heritage to add La Retraite, La Rue de la Retraite, St Saviour to the List of Sites of Special Interest because of its special interest and having regard to the representations made representations, the Minister is further recommended to confirm the addition of this building and place to the List on the basis of the revised schedule included in appendix 3.
