Jersey Police Complaints Authority: Appointment of New Member

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Jersey Police Complaints Authority – appointment of a new member.

 

Decision(s):

The Minister decided to propose the appointment of Dr John Birtwistle as a member of the Jersey Police Complaints Authority (JPCA) for a period of three years with effect from the 1 January 2012, and approved a report and proposition recommending the above appointment.

 

Reason(s) for Decision:

One member of the JPCA has recently been elected as a member of the States, and it is necessary to fill the vacancy with effect from 1 January 2012.  The position was advertised and following an interview by a panel comprising representatives from Home Affairs, the JPCA and the Jersey Appointments Commission, the position was offered to Dr Birtwistle

.

Resource Implications:

There are no additional financial or manpower implications arising from this proposition.

 

Action required:

The Executive Officer, Home Affairs, to request the Greffier of the States to arrange for the attached Proposition to be lodged ‘au Greffe’ for consideration by the States.

Jersey Police Complaints Authority: Appointment of New Member

PROPOSITION

 

THE STATES are asked to decide whether they are of opinion

 

in accordance with Article 2 of, and the Schedule to, the Police (Complaints and Discipline) (Jersey) Law 1999, to appoint the following as a member of the Jersey Police Complaints Authority for a period of three years –

 

  Dr John Birtwistle

REPORT

 

Deputy Steven Luce has recently been elected as a States Member and has relinquished his position as a member of the Jersey Police Complaints Authority.  It is therefore necessary to fill this vacancy with effect from 1 January 2012.

 

The position was advertised in the Jersey Evening Post, and following an interview by a panel comprising of the Chief Officer, Home Affairs; the Chairman of the Jersey Police Complaints Authority; a Senior Human Resources Manager for Home Affairs, and a representative of the Jersey Appointments Commission, the position has been offered to Dr John Birtwistle.

 

The Minister recommends that the following be appointed to serve on the Jersey Police Complaints Authority for a period of three years –

 

Dr John Birtwistle, BSc, MA, Ed D

 

Dr Birtwistle spent 27 years as the States Principal Educational Psychologist with the Education, Sport and Culture Department, and retired in December 2005.  Prior to moving to Jersey he was a Senior Educational Psychologist in Derbyshire and Hull.  From 1979 to 1989 he was also the Head of Special Education in Jersey.  

 

Dr Birtwistle obtained a BSc in Psychology from Birkbeck College in London, an MA in Child Psychology from Nottingham University and in 1999 became a Doctor of Education following a course of study and a research project via Bristol University.

 

Dr Birtwistle has also been the Independent Chair of the Autistic Spectrum Partnership Board which co-ordinates the work of the States and Charitable Bodies such as Autism Jersey and Mencap.

 

He is currently a Lay Member of the Mental Health Review Tribunal.

 

There are no additional financial or manpower implications arising from this proposition.
