Jersey Advisory and Conciliation Service - Appointments to Board

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Jersey Advisory and Conciliation Service – New Board Members

Decision(s): The Minister decided to present a written Report notifying the States of the appointment of two new JACS Board Members.

Reason(s) for Decision: Two members of the JACS Board are retiring at the end of 2008.  Following an open recruitment process, two candidates were selected as appropriate for Board membership; Mr John Moulin and Miss Julie Crabtree.

 

The Schedule to the Jersey Advisory and Conciliation (Jersey) Law 2003, requires that members are to be selected and appointed by the Board, subject to the Minister’s approval, and that the States must immediately be informed of any appointments.

 

Resource Implications: There are no financial or manpower implications.

Action required: States Greffe to arrange for the Report to be presented to the States at the earliest opportunity.

REPORT BY THE SOCIAL SECURITY MINISTER

The Social Security Minister is required, by the Jersey Advisory and Conciliation (Jersey) Law 2003, to inform the States of appointments to the Jersey Advisory and Conciliation Service Board.  

 

Mr Michael Berry, the current Chairman of the JACS Board has reached the end of his second four year term on the Board and Mr John Noel retired from the Board in November 2008.

 

The two available positions were advertised in the Jersey Evening Post in October 2008 and expressions of interest were invited from local organisations that are representative of employers and employees.

 

Following short listing and interviews which were conducted in November 2008 by Mr Thomas Slattery (Chairman designate) and Mr Edmund Daubeney, the Board has selected two new members.

 

The Social Security Minister accepts the recommendation of the JACS Board to appoint Mr John Moulin for a two year term and Miss Julie Crabtree for a four year term on the Board.

 

Mr Moulin is currently the Chief Ambulance Officer and President of the Jersey Civil Service Association. Miss Crabtree is the Human Resources Director for Jersey Post.  It is considered that they will bring valuable knowledge and experience to the Board.

 

In accordance with the Jersey Advisory and Conciliation (Jersey) Law 2003, the Board has chosen Mr Slattery to act as Chairman of the Board from January 2009.  The Board will select a Deputy Chairman from its membership in January 2009.

 

I would like to thank the retiring member Mr Noel and Chairman Mr Berry, for their valuable contribution to the Board and would also like to thank the new Chairman, Mr Slattery and his Board members for their continued hard work and commitment.
