A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): To approve a change to the permitted use of part of La Collette Car Park to allow boat and trailer parking under Article 3 (d) Road Traffic (Public Parking Places) (Jersey) Order 2007, subject to Planning permission being granted.

Reason(s) for decision: To enable the area previously rented for Coach parking to be used for boat and trailer parking.

Action required:

  To request the Minister to ratify the change of permitted use of part of La Collette Car Park to allow boat and trailer parking.

CAR PARK - LA COLLETTE - CHANGE OF PERMITTED USE OF PART OF

Purpose of the Report

The Minister for Transport and Technical Services is asked to approve a request to change the permitted use of a part of La Collette Car Park for boat and trailer parking for the remainder of 2007.

Discussion

Approximately one half of La Collette Car Park had been rented to Tantivy Coaches but they have now vacated this area and it is available for other use.

The other half of La Collette Car Park is used for public parking and is not fully utilised.

There is a demand for boat and trailer parking at La Collette which cannot be fully satisfied with the existing facilities. Currently the Road Traffic (Public Parking Places) (Jersey) Order 2007 does not permit a boat, trailer or other thing to be parked in any of the scheduled car parks, including La Collette. It is proposed to change the permitted use of the area previously rented to Tantivy to allow spaces to be rented out for boat or trailer parking to maintain the income previously received; subject to permission being granted by Planning Department.

The area would only be used for boat and trailer parking until the area is required for the road realignment as part of the development for the Energy from Waste Plant - estimated to be early in 2008.

Recommendations

The Minister is recommended to:

  Approve the request for a change of permitted use of this area to allow parking for boats and trailers

  Instruct Officers to request permission from Planning to amend the Public Parking Places Order to permit boat parking in this area of the car park

  Instruct Officers to request the Law Draftsman to prepare the appropriate Amendment to the Public Parking Places Order for the Minister to sign.

Reason for Decision

To enable the Department to make use of the vacated area and to maintain its current revenue levels.

Action Required

Officers to instruct the Law Draftsman to prepare an Amendment to the Order for subsequent submission to the Minister.
