Ouaisne Bay Deckchairs: Transfer of Beach Trading Licence

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister approved the request to transfer the licence held by Mr Jonathan Steventon, Ouaisne Deckchairs, St Brelade to Kismet Cabana. This permission is granted for the hiring of deck chairs, sun beds, umbrellas and windbreaks within the following designated area of beach at St Brelade, the entire bay at Ouaisne. This transfer of licence will be effective immediately.

Reason(s) for Decision:

Under Regulation 3(1)(d) of the Policing of Beaches (Jersey) Regulations 1959 written permission of the Minister is required to engage in trading on any beach. The Minister is content that the new licence holder is able to fulfil the terms and conditions that apply to the licence for this concession.

Resource Implications:

Additional income generated, no human or additional resource implications.

Action required:

The Hospitality and Leisure Manager to notify Mr Jonathan Steventon and Kismet Cabana that the Minister has granted the transfer of licence and that the licence will be effective immediately.

The Minister is asked to approve the request to transfer the licence held by Mr Jonathan Steventon, Ouaisne Deckchairs, St.Brelade to Kismet Cabana.

 

The permission is granted for the hiring of deck chairs, sun beds, umbrellas and windbreaks within the following designated area of beach at St Brelade, the entire bay at Ouaisne. This transfer of licence will be effective immediately.

 

This transfer is subject to the new concession holder being able to fulfil the terms and conditions that apply to the licence for this concession.

 

Kismet Cabana Business Plan - Executive Summary

 

Ouaisne bay is a popular beach destination for Islanders to enjoy throughout the year.

 

Open since April 2016, Kismet Cabana is proud to have established a valuable and successful service to the bay, providing quality fresh food, refreshments & entertainment to locals and tourists visiting the area as one of only two dining businesses in the bay. As the only concession tailored specifically to outdoor visitors and beach-goers, Kismet is proud to uphold the following key principles with its current business:

 

-          We care about our ingredients and where they are sourced

-          We care about the area and environment (recycling / eco-friendly materials / reduced plastic / encourage responsible use of the bay)

-          We care about the quality of our service and how we can support what we can bring to the bay for both locals and tourists

-          We care about offering opportunities for local talent to grow

 

We are proud to have built up a good reputation on these values, and want to continue to serve our loyal customer base as well as encourage others to enjoy our beautiful bay.

 

2019 sees the opportunity for Kismet Cabana to extend our services to the beach, as we purchase the beach concession for Ouaisne Bay - formerly that of Jonno’s Water-Sports based in St Brelade. Despite ownership, the former owner has not provided the service of deckchairs & loungers to Ouaisne Bay for a considerable amount of time and so Kismet has requested to take ownership to provide a quality service to the area.

 

Key services and opportunities identified as part of this extended concession include:

 

-          The provision of quality deckchairs, loungers, wind-breaks & umbrellas to hire for beach goers

-          The provision of beach items including sun-lotions, towels, beach balls etc to purchase for beach goers

-          The provision of refreshments made to order by Kismet Cabana & delivered directly to beachgoers

-          potential opportunity to organise public events (event plans would be submitted in due course)

-          Ensuring the beach is left clean & tidy by providing metal bbq bins for beach goers

 

As a seasonal business, we are somewhat open to the elements and is must make hay whilst the sun shines. The Beach Concession would be manned by Kismet Staff during opening hours & locked up when closed accordingly. Opening times may vary according to season - we anticipate high season (May - September) open 9am-6pm seven days a week.

 

By having a presence on the beach, Kismet is able to extend our current responsibility for

cleanliness in the area & encouraging the public to clean away their rubbish/bbq’s & limited their

use of plastic / glass on the beach.

 

Christopher Lister is the lead in the business, as business owner and chef. Chris comes with a wealth of experience & growing gravitas in reputation.

 

 

 

Parish Comment 

 

As with all new proposals a consultation process was undertaken with the relevant Constable/s. Following consultation with the Constable of St.Brealde I can advise you that the Constable is supportive of the proposal.  

 

 

 

Recommendation 

  

On the basis of the proposal from Kismet Cabana and following the approval from the Constable may I recommend that Kismet Cabana be given the opportunity to commence this operation.  

 

My recommendation is for the Minister to approve the transfer of the beach trading licence from Mr Jonathan Steventon to Kismet Cabana. This transfer is subject to the new concession holder being able to fulfil the terms and conditions that apply to the licence for this concession.
