Sea Fisheries (Fees) (Jersey) Order 2013

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister made the Sea Fisheries (Fees)(Jersey) Order 2013.

Reason(s) for decision:

To enable Marine Resources to increase its fees and charges in line with the Anti-Inflation Strategy agreed by the States.

Resource Implications:

There are no manpower implications for the States as a result of this ministerial decision.

Action required:  The Greffier of the States Greffe to be requested to make the necessary arrangements to promulgate the Order.

ECONOMIC DEVELOPMENT
 

Approval for making of an Order to increase fees for fishing boat licences, scallop permits and fisheries licences.

 

Purpose of the Report

 

The Minister for Economic Development is asked to approve the making of an Order to increase the various fees and charges for licences and permits administered under the Sea Fisheries (Jersey) Law 1994 with effect from 1 January 2014.


Background

 

Ministerial Decision MD-E-2013-0092 of 9 October 2013 approved the drafting of a Fees Order to raise the fees charged in respect of fishing boat licences, scallop permits and fisheries licences.  The Order had now been drafted and is ready for publication.


Details

 

In accordance with the recommendation of Treasury and Resources the fee increases have been kept below 2.5%.

 

The Department currently charges a fee for the work involved in administering the following:
Issue of new fishing vessel licences

Issue of commercial scallop diving licences

Issue of recreational scallop diving licences

Application and grant fees for concession licences for fish farming

Annual fees per concession for fish farming licences


 

Recommendation

 

The Minister is recommended to approve the making of the Order and to request the States Greffe to take the necessary steps for its promulgation.
