Transport and Technical Services: Fees and Charges Increase 2016 (Excluding Jersey Car Parks)

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):  The Minister approved the increases to the Department’s fees and charges as set out in the attached schedule.

 

Reason(s) for Decision:  To enable the Department to increase its fees and charges by an average of 2.5% from 1 January 2016 in order to meet cash limits and aid towards cost recovery.

 

This Ministerial Decision excludes the charges for Jersey Car Parks which will be under a separate Ministerial Decision.

 

Resource Implications:  The additional income as a result of the proposed increases to fees and charges will enable the department to meet cash limits and aid towards cost recovery.

 

Action required:  The Finance Director to arrange for the Department’s fees and charges to be advertised on www.gov.je.

TRANSPORT AND TECHNICAL SERVICES DEPARTMENT

 

2016 DEPARTMENTAL INCREASES to Fees and Charges

 

 

Purpose of Report

The Minister for Transport and Technical Services is asked to approve a request to increase the Department’s various fees and charges for 2016 (a schedule of charges is attached as Appendix A).

 

 

Discussion

The proposed increases have been limited to 2.5% per annum in line with FD 4.1 “Increases in States Fees and Charges”.  Confirmation has been received from Treasury that although RPI(X) is currently below this figure no further authorisation needs to be sought in order to increase fees by not more than 2.5% on average (within the margins of rounding errors due to low charge levels).

 

Below is a table listing any new charges.

 

It is proposed that the already advertised price for “Non-licensed material containing asbestos” should now be charged at its advertised amount due to the introduction of new ways of disposal methods.  This will be subject to change and a separate report during 2016 when the final costings have been calculated.

 

The Clinical Waste Incinerator is due to close in 2016. The cost of clinical waste disposal will change and the costs will be calculated when the new method of disposal is finalised.

The fees and charges for Jersey Car Parks have not been included as part of this Ministerial Decision but will be brought to the Minister for consideration as a separate report.

 

In accordance with Finance Direction No.4.1 Increases in States Fees and Charges, all increases to charges above 2.5% require the approval of the Minister for Treasury and Resources.   The Treasurer of the States can approve increases to States charges under his delegated powers, where those increases are non-contentious.

 

Driver and Vehicle Standards charges have been rounded to the £ wherever possible, and this has resulted in a small number of charges increasing above 2.5%.  However, these charges are relatively low in terms of income generation and the weighted average increase for DVS is actually below 2.5%.

 


Recommendation

That the Minister approves increases to the fees and charges for 2016 as set out in the attached Appendix A. That the Minister requests the Finance Director to arrange for the Department’s fees and charges to be advertised on the States Website www.gov.je and to be available on request from the department.
