Water Pollution (Code of Good Agricultural Practice) (Jersey) Order 2009: Extension: Approval to provide law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Approval for making of an Order for The Water Code (Jersey) March 2009 as an approved Code of Practice for the purposes of Article 16 of the Water Pollution (Jersey) Law, 2000 until 29 June 2015.

Decision(s): The Minister requested the Law Draftsman to provide for the extension of the Water Pollution (Code of Good Agricultural Practice) (Jersey) Order 2009 as an approved Code of Practice under articles 16 and 52 of the Water Pollution (Jersey) Law 2000 for a further year (to 29th June 2015).

Reason(s) for decision: A new Code of Good Agricultural and Environmental Practice is being developed to include sections on air and soil and the initial consultation has highlighted a number of issues which need resolving, including an opinion from the Law Officers. Therefore an extension is requested to address these. 

Resource Implications:

There are no manpower implications for the States as a result of this ministerial decision.

Action required:  The Land and Horticultural Development Manager to provide the necessary brief to the Law Draftsman.

Purpose of the Report

The purpose of this report is to request that the Minister approve, by Order, The Water Code (Jersey) March 2009 as an approved Code of Practice for the purposes of Article 16 of the Water Pollution (Jersey) Law, 2000 until the 29th June 2015.

 

 

Background and discussion

The Code of Good Agricultural Practice for the Protection of Water, The Water Code (Jersey) is an approved Code of Practice for the purposes of Article 16 of the Water Pollution (Jersey) Law 2000 and was approved by order, The Water Pollution (Code of Good Agricultural Practice) (Jersey) Order 2009. The Order came into force on 29th June 2009 and remains in force for 5 years.

 

Article 16 of the Water Pollution (Jersey) Law 2000 states that the Minister may by Order approve any code of practice for the purposes of this Law

In exercising his or her powers under paragraph (1), the Minister shall have regard to the desirability of 

(a)     the provision of practical guidance to persons engaged in activities (including, in particular, agricultural and related activities) that may affect the quality of controlled waters; and

(b)     the promotion and encouragement of good practices by such persons for preventing, controlling, reducing or eliminating the pollution of controlled waters.

 

The current Water Code (March 2009) was approved by the Minister for Planning and Environment under Article 16 of the Water Pollution (Jersey) Law 2000. The current Code is being updated and will be replaced by a Soil, Air and Water Code (2014). The extension to the current code is required to enable recent revisions of UK legislation to be considered before the new combined code is produced and to clarify legal issues regarding the air and soil components.

 

Recommendation

That the Minister instructs the Director of Environmental Management and Rural Economy to request that the Law Draftsman extends the Water Code Order 2009 until the 29th June 2015.
