Esplanade, St. Helier: Pedestrain Refuge

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

PEDESTRIAN REFUGE ISLAND AND UNLOADING BAY ON THE ESPLANADE

 

 

 

Purpose of the Report

 

To provide a pedestrian refuge and unloading bay on the Esplanade.

 

 

Background

 

Building No 4 of the Jersey International Finance Centre on the site of the Esplanade surface car park has been completed and work has recently commenced on the construction of Building No 5. In order to accommodate the construction site, the long stay parking on the Esplanade car park has been re-located to the temporary car park by Jardin de la Mer. The remaining 194 spaces within the Esplanade Car Park have been converted to “shopper” 3 hour parking spaces.   Approved plans for Building No.4 include an unloading bay on the Esplanade and in discussions with SOJDC it has been agreed that the developer should provide a temporary pedestrian refuge as an interim measure to assist pedestrians crossing the Esplanade prior to future landscaping proposals.

 

 

Discussion

 

Many commuters who park in the temporary car park will walk to town via the Esplanade car park underpass. The number of pedestrians trying to cross the Esplanade is likely to increase, both at peak times and throughout the day with the introduction of shopper parking on the Esplanade car park. The refuge will enable pedestrians to cross the road in two halves making it safer.  It will also reduce the need for pedestrians to walk in front of the site access to Building No.5.

 

The island can be accommodated within the existing road space. However, it will mean the removal of approximately three on-street one hour scratch card parking spaces with parking being prohibited east of a point 38 yards west of Payn Street.  These will be offset by the creation of the 194 shopper parking bays within the car park.

 

The unloading bay is required to enable large vehicles who are unable to use the basement parking area to unload from the Esplanade for Building No 4, or other offices in the area.  It will be designated an unloading bay with a 20 minute time limit at all times, to discourage overnight parking.

 

In accordance with the Highways Encroachment Regulations (Jersey) 1957, and Article 68 of the Road Traffic (Jersey) Law 1956 the Connétable has been consulted and confirmed his support.

 

 

 

Conclusion

 

The pedestrian refuge island can be accommodated within the highway to provide better pedestrian safety. The loss of on-street parking is offset by the new arrangements within the car park.  The unloading bay is required to facilitate servicing to the area.

 

 

Recommendation

 

The Minister is recommended to approve the installation of a pedestrian refuge island and unloading bay and removal of on-street parking to the west of Payn Street on The Esplanade as shown on the attached plan.

The works will be funded by States of Jersey Development Company as part of the Jersey International Finance Centre development.
