Income Support (General Provisions) (Amendment No 3) (Jersey) Order 2009.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Income Support (General Provisions) (Amendment No 3) (Jersey) Order 2009

Decision(s): The Minister made the Income Support (General Provisions) (Amendment No 3) (Jersey) Order 2009.

Reason(s) for Decision: Income Support component rates will rise from 1 October 2009. The component rates are set by Regulation which has been approved by the States (P.93/2009).

Other parameters are set within the General Provisions Order. In the Report accompanying P.93, it was noted that adjustments would be made to various parameters following the publication of the Earnings Index. These adjustments will improve the incentives within Income Support in respect of savings, earned income and pension income for those aged 65 or above.

Resource Implications: There are no manpower implications. The cost of increasing these parameters is included within the cost of uprating Income Support which will be met from within proposed cash limits.

Action required: Notify the Greffe and the Law Draftsman that the Order has been made and forward the signed and sealed Order to the Greffe for notification to the States.

THE MINISTER FOR SOCIAL SECURITY, in pursuance of Articles 7 and 18 of the Income Support (Jersey) Law 2007, orders as follows 

1 Schedule 2 amended

In Schedule 2 to the Income Support (General Provisions) (Jersey) Order 2008 

(a) for paragraph 2(1) there shall be substituted the following sub-paragraph 

“(1) The following amounts of capital shall be disregarded in assessing calculated income 

(a) in the case of a household containing a sole adult under the age of 65 years where a member of the household meets the criteria for the personal care element of the impairment component under paragraph 6 of Schedule 1 to the Regulations

(b) in the case of any other household containing a sole adult under the age of 65 years

(c) in the case of a household containing 2 or more adults who are all under the age of 65 years where a member of the household meets the criteria for the personal care element of the impairment component under paragraph 6 of Schedule 1 to the Regulations

(d) in the case of any other household containing 2 or more adults who are all under the age of 65 years

£14,424

(e) in the case of a household containing a sole adult aged 65 years or over

£13,053

(f) in the case of a household containing 2 or more adults, at least one of whom is aged 65 years or over

£21,636.”;

(b) for paragraph 5 there shall be substituted the following paragraph 

“5 Percentage of income to be disregarded

In assessing the weekly income of the household there shall be disregarded 

(a) 12% of the earnings of any adults in the household who are not entitled to a basic component under Article 5(2)(b) of the Law;

(b) 100% of the income of any children in the household derived from earnings;

(ba) 5% of any income derived from an award of long term incapacity allowance under Article 16 of the Social Security (Jersey) Law 1974 or of invalidity benefit by virtue of Article 18 of the Social Security (Amendment No. 14) (Jersey) Law 2000;

(bb) 10% of any income derived from any qualifying maintenance payment received by any person in the household;

(bc) 5% of any income derived from a pension or annuity of any person in the household aged under 65 years;

(c) 100% of the first £32.69 of any income derived from a pension or annuity of one person in the household aged 65 years or over;

(d) 100% of the first £20.37 of any income derived from a pension or annuity of any other person in the household aged 65 years or over;

(e) in the case of a person entitled to a basic component under Article 5(2)(b) of the Law, either 

(i) 100% of the first £16.24 of earnings;

(ii) 50% of earnings over £16.24 but under £27.09; and

(iii) 25% of earnings over £27.09 but under £48.79,

or 12% of total earnings, whichever results in the greater amount to be disregarded.”.

2 Citation and commencement

This Order may be cited as the Income Support (General Provisions) (Amendment No. 3) (Jersey) Order 2009 and shall come into force on 1st October 2009.
