A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister approved the amendment of the Road Traffic (Grouville) (Jersey) Order 2002 and Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002 to include implementing prohibition of waiting changes on La Grande Route des Sablons and La Rue du Pont prior to Law Drafting by use of an Article 68 Notice.

 

Reason(s) for Decision: To incorporate changes to areas of prohibition of parking and parking areas and to approve an Article 68 Notice for the prohibition of waiting changes to La Grande Route des Sablons and La Rue du Pont so these can be implemented prior to Law Drafting.

 

Resource Implications: Principal Legislative Drafting. IHE officer time.

 

Action Required: Officers to instruct the Principal Legislative Drafter to prepare the Amendment for presentation to the Minister and to prepare and publicise an Article 68 Notice in respect of changes to prohibition of waiting on La Grande Route des Sablons and La Rue du Pont.

AMENDMENT TO ROAD TRAFFIC (GROUVILLE) (JERSEY) ORDER 2002 AND

 

ROAD TRAFFIC (DISABLED PERSONS) (PARKING) (JERSEY) ORDER 2002

 

 

Purpose of the Report

 

To amend the Road Traffic (Grouville) (Jersey) Order 2002 and the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002.

 

 

Background

 

A request has been received from the Connétable of Grouville to make changes to the Road Traffic (Grouville) (Jersey) Order 2002 and the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002 to include new prohibition of waiting areas, new parking restrictions and to add new disabled parking spaces.

 

The Road Traffic (Grouville) (Jersey) Order 2002 and the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002 are administered by Infrastructure, Housing and Environment.

 

 

Discussion

 

The Connétable of Grouville has requested that the following roads have maximum stay parking restrictions scheduled:

 

  • La Grande Route des Sablons (appendix 1) 3 hour maximum stay between 8am and 5pm Monday to Friday with parking disc to be displayed and no return for 1 hour:
    • Add to Schedule 7 “La Grande Route des Sablons (East side from a point 40 yards south of the junction with La Rue des Pres to a point 28 yards further south)”;
    • Add to Schedule 7 “La Grande Route des Sablons (East side from a point 15 yards north of the junction with La Rue des Pres to a point 68 yards further north)”

 

  • La Chasse du Pres (appendix 1) a maximum 7 day stay with a no return for 24 hours:
    • Add to Schedule 8 “La Chasse du Pres (West side from a point 10 yards north of its junction with La Rue des Pres to a point 8 yards south of its junction with La Grande Route des Sablons)”

 

  • La Grande Route des Sablons (appendix 2) extend the existing prohibition of parking on the north side of the road and add 2 new areas on the south side of the road by La Rocque Harbour:
    • Amend the existing entry in Schedule 2 “North side (from a point 50 yards east of its junction with Le Clos du Port for 124 yards in a westerly direction)” to read “North side (from a point 154 yards west of its junction with Le Clos du Port to a point 90 yards east of the junction with La Rue du Pont)”
    • Add a new entry in Schedule 2 “South side (from its junction with Le Clos du Port to a point 154 yards west)”
    • Add a new entry in Schedule 2 “South side (from its junction with La Rue du Pont to a point 98 yards east)”

 

  • La Rue du Pont (appendix 2)
    • Add a new entry in Schedule 2 “Both sides (from its junction with La Grande Route des Sablons to a point 87 yards north)”

 

  • La Rue de la Sente Maillard (appendix 3) a maximum 7 day stay with a no return for 24 hours:
    • Add to Schedule 8 “La Rue de la Sente Maillard (South side from a point 57 yards west of its junction with La Grande Route des Sablons to a point 131 yards further west)”
    • Remove the entry in Schedule 2 and replace with “Both sides from its junction with La Grande Route des Sablons to a point 57 yards west”
    • Add to Schedule 2 “South side (from a point 188 yards west of its junction with La Grande Route des Sablons to a point 11 yards further west)”;

 

  • La Vieille Rue (appendix 4) add a new prohibition of waiting area:
    • Add to Schedule 2 “La Vieille Rue (South side from a point 23 yards west of its junction with Le Boulivot de Haut to a point 26 yards further west)”

 

  • Le Mont de Gouray (appendix 5) add a new prohibition of waiting area:
    • Add to the existing entry for Le Mont de Gouray in Schedule 2 “North side (From a point 116 yards east of the junction with La Chevre Rue to the Parish boundary with St. Martin)”

 

  • La Rue de la Haye du Puits (appendix 6) add a new prohibition of waiting area:
    • Add to Schedule 2 “La Rue de la Haye du Puits (North side from its junction with Rue de la Croix to a point 7 yards west)”

 

  • La Rue des Fonds (appendix 7) add a new area of prohibition of waiting:
    • Add to Schedule 2 “La Rue des Fonds (West side from a point 40 yards south of its junction with La Rue de la Haye du Puits to a point 18 yards further south)”

 

  • Le Vier Mont (appendix 8) add a new prohibition of waiting area:
    • Add to Schedule 2 “Le Vier Mont (North side from its junction with La Rue a Don to a point 65 yards further east)”

 

  • Le Vier Mont (appendix 8) add an exemption to a scheduled one way traffic flow for cyclists:
    • Add an exemption in Schedule 1 for the entry for Le Vier Mont (east of Le Chemin du Radier) for cyclists

 

  • La Rue du Pont (appendix 9) add a new prohibition of waiting area:
    • Add to Schedule 2 “La Rue du Pont (East side from a point 27 yards south of its junction with La Rue du Puits Mahaut to a point 13 yards further south)”

 

  • Limpet Lane – formerly Le Chemin Public (appendix 10) amend the entry for Le Chemin Public in Schedule 2 to reflect the change of name of the road to Limpet Lane:

 

  • New Road (appendix 10) replace the existing area of prohibition of waiting in Schedule 2:
    • North side from the junction with Gorey Village Main Road to a point 33 yards east
    • North side from a point 46 yards east of the junction with Gorey Village Main Road to a point 106 yards further east

 

  • New Road (appendix 10) add to Schedule 6 a new 3 hour disc maximum stay parking area:
    • North side from a point 33 yards east of the junction with Gorey Village Main Road to a point 13 yards further east

 

  • Old Road (appendix 10) replace the existing entry in Schedule 2 Prohibition of Waiting:
    • North side from the junction with Gorey Village Main Road to a point 20 yards east
    • North side from a point 30 yards east of the junction with Gorey Village Main Road to a point 6 yards east of the junction with Limpet Lane (formerly Le Chemin Public)
    • South side from the junction with Gorey Village Main Road to a point 117 yards further east

 

The changes to areas of prohibition of waiting on La Grande Route des Sablons and La Rue du Pont have been identified as being a priority for the Parish and it is requested that these be implemented prior to Law Drafting by means of an Article 68 notice so the Honorary Police can control dangerous and obstructive parking throughout the summer period.  Disruption to traffic flow and delays to the bus route have been identified during recent weekends.

 

The Connétable of Grouville has also requested the introduction of two new areas of parking for use by disabled drivers holding blue badges be added to the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002:

 

  • La Rue de la Haye du Puits (appendix 5):
    • Add to Schedule 1 for Grouville 1 hour limit “La Rue de la Haye du Puits (North side from a point 65 ½ yards west of its junction with Rue de la Croix to a point 13 yards further west)”

 

  • La Rue a Don (appendix 11):
    • Add to Schedule 1 for Grouville 2 hour limit “La Rue a Don (North side from the eastern entrance of Grouville Parish Church to a point
    • 7 yards further east)”

 

Conclusion

 

The addition of the requested prohibition of waiting areas and new maximum stay periods above will allow the Parish to police parking in these areas and provide for better use of the facilities.

 

 

 

 

 

Recommendations

 

The Minister is recommended to instruct Officers to issue Law Drafting instructions to amend the Road Traffic (Grouville) (Jersey) Order 2002 and the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002.
