BBC Licence Fee Increase 2021

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision:

The Minister agreed that the Communications (Television Licensing) (Amendment) Regulations 2021 should extend to Jersey. The Regulations increase the price of television licences issued on or after 01 April 2021 from £157.50 to £159.00 for a colour licence and from £53.00 to £53.50 for a black and white licence. The Regulations come into effect on 1st April 2021.

Reasons for Decision:  

The UK Secretary of State for Digital, Culture, Media and Sport sets the level of television licence fees each year and issues Regulations to implement the price increase. These are extended to Jersey under authority of the Broadcasting and Communications (Jersey) Order 2004. In order to take effect in Jersey, the Regulations must be registered by the Royal Court, and the Minister for Economic Development, Tourism, Sport and Culture is required to request that this takes place.

Resource Implications: There are no financial or staffing resource implications arising from this decision. 

Action required: Officers to inform the Crown Advocate of the Minister’s Decision.

Summary

 

Purpose

The Minister is asked to sign the Ministerial Decision to approve of the registration of The Communications (Television Licensing) (Amendment) Regulations 2021 (“Amendment Regulations”) within the Royal Court in Jersey.  These Amendment Regulations refer to the annual uplift in television license fees.

 

As in previous years. the Secretary of State for Digital, Culture, Media and Sport sets Regulations for television licence fees each year under authority of the Broadcasting and Communications (Jersey) Order 2004.  These Regulations are then passed to Jersey’s Minister of for Economic Development, Tourism, Sport and Culture for approval and lodging within the Royal Court.

 

Approval and lodging within the Royal Court indicates Jersey recognises that Amendment Regulations for 2021 will see the television licence fee increase in-line with the Consumer Price Index from £157.50 to £159.00 for a colour licence and from £53.00 to £53.50 for a black and white licence, and increase the sums payable by way of instalments under the various instalment schemes. 

 

The Amendment Regulations come into force on the 1st April 2021 and have effect in respect of television licences issued on or after 1 April 2021.

Please refer to the attached copy of The Communications (Television Licensing) (Amendment) Regulations 2021 (see file “SI 2021-124- The Communications (Television Licensing) (Amendment) Regulations 2021 SI.pdf”) which provides full breakdown of the pricing schedule which will come into force on 1 April 2021.  This document has sent to the Royal Court via official channels from the Department of Digital, Culture, Media and Sport.

 

Guidance

As with previous years, the TV Licensing will ensure that licence fee payers are made aware of the increase to the television licence fee and methods of payments.  Existing guidance on the TV Licensing website (https://www.tvlicensing.co.uk/pay-for-your-tv-licence/ways-to-pay) will be updated by the time the increase comes int effect on 1 April 2021.
