Waterfront Enterprise Board: Appointment of Director.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Waterfront Enterprise Board Limited, Appointment of a New Director

Decision(s): 

The Chief Minister, acting in accordance with a decision of the Council of Ministers (Minute No. B5 of 24th July 2008 refers) –  

(a)  approved a report and proposition recommending the appointment of Deputy John Benjamin Fox as a States Director of the Waterfront Enterprise Board Limited from 1st November 2008 until 31st March 2009; and 

(b) determined that the draft report and proposition should be lodged ‘au Greffe’ at the earliest opportunity with a view to securing a States debate on 21st October 2008.

Reason(s) for Decision:   

  • Following the resignation of Senator James Perchard from his post as States Director of the Waterfront Enterprise Board Limited, it is necessary for the States’ to appoint a new Director to fill this now vacant position; and

 

  • Deputy Fox has considerable skills and experience that will enable him to make a valuable contribution to the work of the Board.

Resource Implications:  None.

Action required: Request the Greffier of the States to ensure that the Report and Proposition is lodged ‘au Greffe’ at the earliest opportunity.

PROPOSITION

 

THE STATES are asked to decide whether they are of opinion  -

 

(a) to appoint Mr. John Benjamin Fox from 1st November 2008 until 31 March 2009 as a States Director of the Waterfront Enterprise Board Limited;

 

(b) to request the Greffier of the States to notify the company of the States’ decision.

REPORT

 

The States established the Waterfront Enterprise Board (WEB) Limited in 1995 as a separate legal entity to act as a development agency of the States for an initial period of 10 years. This initial period was extended for a further 10 years by the States on 14th September 2005. The WEB Memorandum and Articles of Association provide that, unless and until determined by the company by ordinary resolution, the number of Directors shall be 7, with 3 States Directors, 3 non-States Directors and the Managing Director. All States Directors and non-States Directors are appointed by the States, and the Managing Director is appointed by the Board. The States also appoints the Chairman who must be a non-States Director. 

Following the resignation of Senator J.L. Perchard, who was appointed as a States’ Director on 28th March 2006 for a 3-year period expiring on 31st March 2009, it is now necessary for the States’ to appoint a new Director.  I am pleased to be able to nominate Deputy Benjamin John Fox as a Director.  Deputy Fox will serve out the remainder of Senator Perchard’s appointment.  Deputy Fox has years of experience in the property and planning sector, as a serving member of the Association of Chief Police Officers (ACPO) National Project and Design Group, Technical Committee on Design Against Crime – Through Environmental Design – Secured by design, and in the time he served on the Urban Renewal Sub Committee and the Planning Sub-Committee.  I am pleased that he is willing to allow his name to go forward for nomination for a term of office.  He is already well known to States members and the public in his role as Deputy and as Assistant Minister of Education, Sport and Culture.  I know that he will bring a wealth of expertise to this post.     

  

The role of the Waterfront Enterprise Board has been to promote, coordinate and implement a comprehensive strategy for the development of the St. Helier Waterfront, with a particular focus on the area known as ‘West of Albert’. This work is still very much in progress, and it is planned that the majority of the project will be completed by 2011.

 

Finally, I would like to place on record my thanks to Senator James Perchard for his service as Director of the Board. During his period as Director, Senator Perchard has overseen an intense period of activity, and I am greatly indebted to him for the contribution that he has made to the development of the St. Helier Waterfront.
