Information about the publication of Ministerial Decisions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister approved the holding of open days by the Modern and Military Arms Association on the dates set out in the attached report.
Reason(s) for Decision: Under the terms of Article 14 of the Firearms (Jersey) Law 2000, the prior written permission of the Minister for Home Affairs is required for any shooting club to hold an ‘open day’ at which members of the public, who are not club members, or bona fide guests of members, are entitled to shoot firearms without holding a firearm certificate. The Modern and Military Arms Association is an approved shooting club and has been asked to introduce some members of the social clubs of two local businesses to rifle and pistol shooting. The open days will take place at the main range at Crabbé.

Background

Article 14(2)(c) of the Firearms (Jersey) Law 2000 (‘the Law’) provides that a person who is neither a member nor a bona fide guest of a member of a shooting club may, on an authorized open day and while under the supervision of a member of such a club, have in the person’s possession without holding a firearm certificate a firearm and ammunition while engaged in or in connection with target shooting at a range which is being used by that club.

An ‘authorized open day’ is defined in Article 14(3) of the Law as a day on which a shooting club has, with the prior written authority of the Minister for Home Affairs, invited members of the public to engage in target shooting.

The Assistant Minister for Home Affairs, who is the Chairman of the Firearms Law Liaison Group, recently wrote to all the shooting clubs to remind them of the requirement to obtain the written permission of the Minister for Home Affairs before holding open days.

Application

Mr Richard Le Brocq, who is the Honorary Secretary of the Modern and Military Arms Association, has applied on behalf of the Association to hold open days on the following dates:

24 October 2015

The purpose of the open days is to introduce some members of the social clubs of two businesses to rifle and pistol shooting.

The Modern and Military Arms Association is an approved shooting club and will be holding the open days at the main range at Crabbé.

Recommendation

It is recommended that the Minister approves the holding of the open days on the above-dates by the Modern and Military Arms Association.
