Road Traffic (St. Clement) (Jersey) Order 1987: Amendment: Law Drafting Instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

AMENDMENT TO ROAD TRAFFIC (ST. CLEMENT) (JERSEY) ORDER 1987

 

 

Purpose of the Report

 

To amend the Road Traffic (St. Clement) (Jersey) Order 1987.

 

 

Background

 

A request has been received from the Connétable of St. Clement to make some changes to the Road Traffic (St. Clement) (Jersey) Order 1987 to include 6 foot 6 inch width restrictions and new prohibition of waiting.

 

The Road Traffic (St. Clement) (Jersey) Order 1987 is administered by Infrastructure, Housing and Environment.

 

 

Discussion

 

The Connétable of St. Clement has requested that La Rue de La Houguette and La Rue du Prince have a restriction for all vehicles exceeding 6 feet 6 inches in width as the road is unsuitable for these larger vehicles.

  • Add an Article covering the Driving and Stationing of certain vehicles to enable the restriction for vehicles with an overall width exceeding 6 foot 6 inches from being driven on Scheduled roads
  • Add a new Schedule to include roads on which vehicles with an overall width which exceeds 6 foot 6 inches are prohibited from being driven and include “La Rue de La Houguette” and “La Rue du Prince”.

 

The Connétable has requested the addition of three new areas of prohibition of waiting on La Rue de La Croix.

  • Add to Schedule 2 – Prohibition of Waiting before the entry for La Rue au Blancq a new entry for La Rue de la Croix “South side (from a point 28 yards west of La Rue du Pontlietaut to a point 11 yards further west)”
  • Add to Schedule 2 a further entry for La Rue de la Croix “South side (between a point 46 yards west of La Rue de Pontlietaut to a point 19 yards further west)”
  • Add to Schedule 2 a further entry for La Rue de la Croix “South side (between a point 120 yards west of La Rue du Pontlietaut to a point 10 yards further west)”

 

The existing prohibition line on La Grève d’Azette has been extended to a point east of the junction with Green Road and this requires amending in the Order to reflect this.

 

La Grève d’Azette

  • Amend the current entry (c) in Schedule 2 – Prohibition of waiting from the current “south side from a point 44 yards west of the eastern boundary of the property known as “Maison Victor Apartments” to the boundary of the Parish of St. Saviour” to read “south side from the boundary of the parish of St. Saviour to a point 20 yards east of the junction with Green Road”;
  • Amend the entry in Schedule 3 – Parking discs from the current “south side, from a point 16 yards east of its junction with Green Road to a point 44 yards further east” to read “south side from a point 20 yards east of its junction with Green Road to a point 26 yards further east”.

 

 

Conclusion

 

The addition of the requested prohibition of waiting areas above will allow the Parish to police parking there.

 

 

Recommendations

 

The Minister is recommended to instruct Officers to issue Law Drafting instructions to amend the Road Traffic (St. Clement) (Jersey) Order 1987.
