Sand Racing (Jersey) Order 2013: Amendment: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister approved the preparation of an Order under Article 2 of the Motor Vehicle Races (Jersey) Law 1946 to enable an amendment to the Sand Racing (Jersey) Order 2013.

 

Reason(s) for Decision: The Minister accepted that the proposed Beach closure and associated traffic management appeared both reasonable and justified.

THE JERSEY MOTOR CYCLE AND LIGHT CAR CLUB’S APPLICATION

 

TO AMEND THE SAND RACING (JERSEY) ORDER 2013

 

 

Purpose of the Report

 

To obtain a Ministerial Decision regarding approval of the Jersey Motor Cycle and Light Car Club’s (JMC&LCC) proposed change to its previously approved Sand Racing Schedule for 2013.

 

In addition, to enable an instruction to be sent to the Law Draftsman requesting preparation of an Order to amend the Sand Racing (Jersey) Order 2013.

 

 

Background

 

The Jersey Motor Cycle and Light Car Club (the Promoter) has submitted details of a proposed change to its schedule of racing events during 2013.  The events are enabled by Order of the Minister for Transport and Technical Services under Article 2 of the Motor Vehicle Races (Jersey) Law 1946.

 

As per the requirements of the Law, Economic Development (Jersey Tourism) has been consulted regarding the proposed change and the Promoter has also gained Parish approval.

 

 

Discussion

 

Sand Racing: The Promoter has applied to change the location of a sand racing event on 20 July from St Ouen (Le Braye) to West Park to provide better facilities for spectators and competitors.

 

It is very unusual for the Club to make such a request after their original applications have been consigned to Law. However we believe this to be a one off case and have been assured that the Club will not be requesting such amendments in the future.

 

 

Recommendation

 

The Minister is recommended to approve the preparation of an Order to amend the Sand Racing (Jersey) Order 2013.

 

 

Reason(s) for Decision

 

The proposed change of beach venue is reasonable and justified.
