Employment Forum Membership

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Employment Forum Membership

Decision(s): The Minister decided to appoint Mr Darren Vibert to the Employment Forum as an “employee” representative, for a three year term, starting on 1 May 2010.

Reason(s) for Decision: Mr Vibert was identified as a suitable applicant during a period of open recruitment and selection undertaken by the Forum during the period July to September 2009, however Mr Vibert was unable to take up the position in November 2009 after the former employee representative’s term came to an end.

Resource Implications: There are no financial or manpower implications.

Action required: The Minister to formally approve the appointment. It is not necessary to inform the States of the appointment.

BACKGROUND  

The Employment Forum is intended to consist of nine members, appointed on the basis of their interest in employment relations and diversity of backgrounds, with three employer, three employee and three independent representatives.  The Employment (Jersey) Law 2003 requires that a Chairman and eight members are appointed by the Social Security Minister.  The current membership is as follows;

RECRUITMENT PROCESS 

In July 2009, an advertisement was placed in the Jersey Evening Post, on the Social Security ‘Jobs in Jersey’ website and was sent to all of those on the Forum’s consultation database (approximately 200 contacts, including employers and employees, trade unions and employers associations).  Three suitable candidates were identified to fill the vacancies and those members were appointed from 1 December 2009. 

The Forum was aware that Rosemary Pestana’s first term on the Forum was due to end as of 31 October 2009 and that Mrs Pestana would not be requesting a second term.  The Forum had identified a second potentially suitable “employee” representative during the 2009 recruitment process, however he was unable to take up a position on the Forum at that time.  The Forum had therefore agreed to approach him again in 2010.  Mr Vibert has confirmed that he is now available to join the Forum. The Forum proposes the appointment of Mr Vibert for a three year term, starting on 1 May 2010.  

Mr Vibert is a staff representative for the GMB trade union and has worked at Jersey Telecom for seven years. He is currently the Senior Commercial Administrator for the Shared Services Division. Mr Vibert’s trade union duties have included negotiation on employment matters with senior managers and disciplinary matters concerning GMB members. Mr Vibert’s previous experience includes five years working in the finance industry.   

Independent representative - The Forum is seeking an independent person (not a trade union representative or business manager/owner), ideally with experience or knowledge of economics or statistics.
