Ministerial Responsibilities: Health and Social Services Department.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister delegated responsibility for the Social Services Department to the Assistant Minister for Health and Social Services Department.

Reason(s) for Decision: Whilst the Minister for Health and Social Services Department will maintain responsibility for the whole H&SS department a more even distribution of workload will be achieved by assigning special responsibility for Social Services to the Assistant Minister.

Resource Implications: None

Action required: The CEO to notify the Chief Ministers Department of the above decision. In accordance with Article 30 of the States of Jersey Law, the Decision will be presented to the States and tabled at the next available States sitting.

Health and Social Services Department Report

Ministerial Responsibilities

The Health and Social Services Department is the largest States Department with a revenue budget in excess of £140M and employs over 2140 fte. Given this wide portfolio of services it is appropriate to delegate some aspects of that portfolio formally to Senator James Perchard, Assistant Minister for Health and Social Services.

Accordingly, the Assistant Minister will have political accountability for:

  • The performance of the Social Services Department against agreed plans, its conformance to relevant processionals standards and the effectiveness of its governance arrangements

 

  • The contribution which Social Services make to the tasks, activities and responsibilities which are discharged through multi-Departmental and multi-agency working.

 

  • Ensuring that the work and the contribution of the Social Services Department continues to be fully integrated with the health services of the overall Department at all levels.

 

  • Fulfilling the Corporate Parent role in relation to the Children’s Executive Service, liaising with the Ministers of Home Affairs and Education, Sport and Culture as appropriate.

 

This delegated function is with immediate effect.
