Social Security (Collection of Contributions) (Jersey) Order 2013, and Social Security (Contributions) (Amendment No. 14) (Jersey) Order 2013

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister made the Social Security (Collection of Contributions) (Jersey) 2013 Order and the  Social Security (Contributions) (Amendment No  14)  (Jersey) Order 2013.

 

Reason(s) for Decision:   The Control of Housing and Work (Jersey) Law 2012 will come into force on July 1st 2013.   This Law will introduce a registration card which will carry the card holder’s Social Security number and their liability code.  Therefore the Social Security card is no longer required and the contributions orders have been amended to remove reference to the card.  The orders have also been amended to describe the information which must be retained by employers employing Class 1 people, given they will no longer be called upon to retain a card.

Introduction

 

The contribution orders (given below) have been amended to remove reference to a ‘Social Security card’ and the requirement for employers of Class 1 employees to retain a Social Security card.  These amendments have been made in preparation for The Control of Housing and Work (Jersey) Law 2012 which will come into effect on July 1st 2013.

Background

The Control of Housing and Work (Jersey) Law 2012 will come into force on July 1st 2013.   This Law will introduce a registration card which will be issued to individuals who move house (seeking to buy or let a property) or change employment.  New arrivals to Jersey will also be required to obtain a registration card before they can commence employment, rent or buy a property.  In effect the new Control of Housing and Work Law merges the existing housing and regulation of undertakings laws.  

 

The registration card will display the individuals housing and work qualifications.  These range from ‘Entitled’ to ‘Registered’, replacing the current a to k category system.

 

The new registration card will also carry the card holder’s Social Security number and liability code, therefore it is no longer necessary to separately issue a Social Security card.  However a insured person is still required, under the 1974 Law, to apply for a social security number and a liability code. 

 

The provisions for collecting Class 1 and Class 2 contributions remain unchanged.

 

Reason for Decision

 

A States wide reform strategy calls for closer working between departments and new thinking to develop more efficient processes.  The replacement of the Social Security card with a Registration Card which meets the needs of both the Social Security Department and the Population Office offers an opportunity to avoid duplication.  Therefore Social Security has worked with the Population Office to develop a complimentary process.  This process has required amendments to the contribution orders to remove reference to a Social Security card and the requirement for this card to be retain by employers of Class 1 employees
