82 (Original Wine Bar), Bath Street, St. Helier, retained as Building of Local Interest.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

This report has been prepared by the Jersey Heritage Trust as part of its responsibility under a Service Level Agreement to provide reports and recommendations to the Minister for Planning and Environment on the registration of historic buildings and sites.

The Planning and Environment Department requested on 23 July 2007 that the Jersey Heritage Trust assess the architectural, historical and other interests of 82 Bath Street ahead of discussions with the Ministerial Registration and Listing Advisory Group.

Relevant interests of the site (also see assessment form)

No.82 appears to have been built as a shop in the period 1900-1920 and the building retains its Edwardian character and architectural features indicative of the period. There is a timber shopfront with large fluted consoles to the fascia and green glazed tiles on the stall-riser, and a residential upper floor with canted bay window and adjacent 2-pane window with rendered trim. The roof pitch is unusually shallow and may have been altered following a fire in 1971.

Advice received (MRLAG or others)

MRLAG carried out an external inspection of the property at its meeting on 13 August 2007. Members unanimously recommended that No.82 be retained on the Register as a BLI.

JHT recommendation

82 Bath Street should be retained on the Register as a BLI as it retains its historic character and interest and makes a positive contribution to the streetscape.

Justification relating to criteria

82 Bath Street satisfies the criteria for registration as a Building of Local Interest as set out in the Interim Policies for the Conservation of Historic Buildings, which state that ‘Buildings included in the Register are those which retain their historic form and detail, and so make a significant and positive contribution to the architectural and historical character and appearance of Jersey’.
