Social Security Advisory Council: Appointment of New Member

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The Minister decided to appoint Mrs Daphne Aubert as a new member of the Social Security Advisory Council with effect from 1 June 2010 for a period of three years.

Reason(s) for Decision:

Mrs Daphne Aubert was an ad-hoc member of the Social Security Advisory Council. On 23 May 2010 Mrs Aubert put her name forward for a first term of three years as a full member. The Minister has decided to appoint Mrs Aubert, bringing the Council to the approved complement of Chairman plus eight members.

Social Security Advisory Council – appointment of a new member  

The Social Security Advisory Council (SSAC) was set up in 2003 as an independent body to provide advice on Social Security issues to the Minister for Social Security. As an established advisory committee there is no requirement for participation of the Appointments Commission in the selection of members. 

Under Article 42 of the Social Security (Jersey) Law 1974, the Council shall consist of a chairman and not fewer that four, nor more than eight other persons, all of whom shall be appointed by the Minister. 

Mrs Daphne Aubert who sat on the Council as an ad-hoc member expressed an interest during a meeting of 20 May 2010 in becoming a full member for a first term of three years. 

During 2009 the Council comprised a chairman plus six members and the intention was for the number of members to increase. This appointment will have the effect of bringing the Council to the approved full complement of Chairman plus eight members. 

The Minister has appointed Mrs Daphne Aubert as a full member of the Social Security Advisory Council for a term of three years with effect from 1 June 2010.
