Perry Farm, La Rue du Maistre, St. Mary: Listed as Grade 3

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister for Planning and Environment resolved to List the building and/or place specified above as a Grade 3 Listed building in accord with the revised Listing Schedule

Reason(s) for decision:

Having regard to the representations received, Jersey Heritage has revised its recommendation to the Minister to List the building at Grade 3, instead of Grade 2, which has been duly taken into account and considered by the Minister;

The special interest of Perry Farm La Rue du Maistre as set out in the schedule and relative to the published criteria for selection, justifies its Listing in accordance with the provisions and purposes of the Planning and Building (Jersey) Law 2002.

Legal and resource implications:

Article 51(2)(b) of the Planning and Building (Jersey) Law 2002 enables the Minister to include on the List of Sites of Special Interest those buildings and places that the Minister is satisfied has public importance by reason of the special archaeological, architectural, artistic, historical, scientific or traditional interest that attaches to the building or place.

In amplification of the requirement of;

i)                    Article 51 Paragraph 3(a) to show in relation to each site included on the List which one or more of the special interests set out in paragraph (2) attaches to the site;

ii)                   Article 51 Paragraph 3(b) to describe the site with sufficient particularity to enable it to be easily identified and;

iii)                 Article 51 Paragraph 3(d) to specify any activity, referred to in Article 55 Paragraph (1), which may be undertaken on the site without the Minister’s permission;

 

the following supports the Minister for Planning and Environment’s view that the site known as Perry Farm, La Rue du Maistre in the Parish of St. Mary is of special interest.

Statement of Significance 

This C19 property, with earlier C17 and C18 origins, retains its historic character with original features of notable quality and rarity including an impressive tourelle and double round-arched entrance.

iv)

Description 

House (2 storey, 5 bay) with 2 ranges of farm buildings to east and west forming a courtyard. Double archway at end of long drive on to La Rue du Maistre (rebuilt in this position in 1924 by the Le Feuvre family, as originally enclosed the courtyard in front of the house). House: slate roof with two rendered chimneys to each gable. To north slope a central tower with crenellated top rises to 4 storeys. Walls rendered with ashlar effect and rusticated quoins to south, random rubble to north. To south central bay is entrance porch - rendered with mouldings, to north central bay a flat roofed rendered extension. East range includes marriage stone 17 CH EDP 42, with central shield.
Interior includes a corbelled fireplace and impressive tourelle stair, which J. Stevens states is one of the best and highest circular stone staircases recorded in Jersey, unusually continuing for two flights (restored by John Le Bailly in 1980s).

Mid-late C19 with C17 & C18 remains.
