Budget Transfer: Waste Cell Projects

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  The transfer of up to £300,000 from the Asbestos Waste Disposal Capital Head of Expenditure to the Waste: Ash Pit La Collette Capital Head of Expenditure in order to consolidate Waste Cell Projects under a single capital head of expenditure.

 

Decision(s):  The Minister for Infrastructure agreed to request the Minister for Treasury and Resources approve the transfer of up to £300,000 from the Asbestos Waste Disposal Capital Head of Expenditure to the Waste: Ash Pit La Collette Capital Head of Expenditure in order to consolidate Waste Cell Projects under a single capital head of expenditure.

 

Reason(s) for Decision:  Article (18)(c) of the Public Finances (Jersey) Law 2005 states that all or any part of the amount appropriated by a head of expenditure may, with the approval of the Minister for Treasury and Resources, be transferred from one head of expenditure to another head of expenditure for any purpose.

 

Delegation 1.2 delegates authority for non-contentious transfers between heads of expenditure of up to £1,000,000 to the Treasurer of the States.

 

Resource Implications:  The Waste: Ash Pit La Collette Capital Head of Expenditure budget to increase by £300,000 and the Asbestos Waste Disposal Capital Head of Expenditure to decrease by £300,000.

 

This decision does not change the total amount approved by the States of Jersey.

 

Action required:  The Finance Director to request the Treasurer of the States to approve the transfers from revenue to capital as referred to in the accompanying report.

TRANSFER BUDGET FROM ASBESTOS WASTE DISPOSAL CAPITAL HEAD OF

 

EXPENDITURE TO WASTE: ASH PIT LA COLLETTE CAPITAL HEAD OF EXPENDITURE

 

 

  1. Purpose of Report

 

To allow the Minister to approve the transfer of up to £300,000 from the Asbestos Waste Disposal Capital Head of Expenditure in order to consolidate Waste Cell projects under a single capital head of expenditure.

 

 

  1. Background

 

The Asbestos Waste Disposal project was completed successfully in the 2nd quarter of 2017. There was a high risk that a significant number of old asbestos containers would not be able to be moved due to corrosion and that this would slow the project down and add costs. Fortunately the containers were in better condition than first expected and the selected contractor undertook the works in a safe, expedient and professional manner.

 

It is proposed that the remaining capital be transferred to enable a further hazardous waste pit or “ash cell” to be constructed. This additional pit will be required to replace the existing hazardous waste pit “Cell 33”.

 

Cell 33 was originally constructed to contain the hazardous air pollution residues from the Energy from Waste plant. Since construction all of these residues from the La Collette EfW have now been shipped off island and further arisings are shipped as they are produced.

 

There is however a requirement to have adequate back up storage for air pollution residues should there be a change of policy or a problem with the shipping of this waste.

 

Cell 33 is now used as the contingency cell, for reception and the disposal site for contaminated soils. It is was built to a higher specification than the other ash cells and is licenced to accept appropriate hazardous wastes. Cell 33 is now 70% full. Most of the waste disposed in cell 33 came from the Jersey Development Company International Finance Centre (IFC) project.

 

A further hazardous waste cell is required to ensure that there is an available contingency cell and an appropriate route for hazardous wastes from the continuing IFC project or from any other sites on the island that have a requirement to dispose of such waste.

 

If approved, the remaining capital from the asbestos waste disposal project will be amalgamated with existing ash pit capital to form adequate funding capital for a new ash cell constructed to the higher hazardous standard. This cell will become Cell 38.

 

 

  1. Recommendation

 

The Minister is recommended to approve the transfer of up to £300,000 from the Asbestos Waste Disposal Capital Head of Expenditure in order to consolidate Waste Cell projects under a single head of expenditure
