Motor Traffic (Cabs - Fares and Charges) Order 2007

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister made the Motor Traffic (Cabs – Fares and Charges) (Jersey) Order 2007 which will increase controlled taxi fares with effect from 9th July 2007.

Reason(s) for decision:

To make the Motor Traffic (Cabs – Fares and Charges) (Jersey) Order 2007, to allow an increase in controlled taxicab fares.

The Order now makes it clear that the maximum hire charge for the hire of a controlled taxicab is calculated in accordance with the Schedule to the Order. It is permissible for taxicab licence holders to charge less than the fare displayed on the meter.

Action required:

Return the hard copy of the Order to the Publications Editor at the States Greffe as soon as it has been signed, sealed and dated.

The Department to produce revised tariff cards for display in controlled taxicabs.

Advise controlled taxicab licence holders to present their taxicabs to the Department at a convenient time after the Order takes effect to have their meters checked and sealed.

TAXI FARE INCREASE 2007

Purpose of the Report

To consider the Motor Traffic (Cabs – Fares and Charges) (Jersey) Order 2007, which will increase controlled taxicab tariffs.

Background

Controlled taxicab tariffs are set by the Minister, under the Motor Traffic (Jersey) Law, 1935. The last increase (3.1 percent) occurred in July, 2006. In May, the Jersey Taxi Drivers Association applied for an increase in tariffs requesting an average increase in tariffs of 4.5 percent, a doubling of extras, increased tariffs for those vehicles carrying more than 4 persons and extending the Sunday tariff to Friday evening and Saturday.

Discussion

A series of meetings has taken place with representatives of the Taxi Drivers Association to discuss the claim.

At the last meeting on 7th June, the Minister made it plain to the JTDA that the claim would not be met, that the offer of an average of 4.5 percent on tariffs was reasonable in the light of the running costs of the operators and the general cost of living.

The JTDA representatives pleaded that extras had not risen for over 20 years while changes in air travel had meant more bags and heavier bags were being carried and there was much more sharing of taxicabs by passengers.

Following discussion, a final offer of 4.5 percent on tariffs, increasing the charge for each bag to 20 pence and each passenger to 20 pence while reducing the charge for a hire starting at the airport or harbours to 20 pence, was accepted by the JTDA.

Currently, these charges are mandatory. This does not allow those licence holders who wish to ignore extras or offer a discount on the fare, the opportunity to do so. In view of this, it is proposed that Article 2 of the Order incorporates the term “maximum hire charge” so that licence holders may charge less than the fare shown on the meter.

The Law Draftsman was asked to prepare the necessary changes to the Order on the basis of a brief provided by the Department.

The Motor Traffic (Cabs – Fares and Charges) (Jersey) Order 2007 is attached for the Minister to make the Order. Making the Order will implement the increase in charges described above and will come in to force on 9th July, 2007.

The Department will make the necessary arrangements with the Controlled Taxicab licence holders to present their vehicles at Driver and Vehicle Standards to have their taxi-meters checked and sealed.

Recommendation

The Minister is recommended to make the Motor Traffic (Cabs – Fares and Charges) (Jersey) Order 2007 and request the Department to take the necessary action to implement the Order.
