Road Traffic (St. Helier) (Jersey) Order and Road Traffic (Disabled Persons) (Parking) (Jersey) Order: Proposed amendments

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

ROAD TRAFFIC (DISABLED PERSONS) (PARKING) (JERSEY) ORDER 2002

 

 

Purpose of the Report

 

To amend the Road Traffic (St Helier) (Jersey) Order 1996 and the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002.

 

 

Background

 

Both the Minister for Infrastructure and the Connétable of St Helier have published Notices under Article 68 of the Road Traffic (Jersey) Law 1956 to make temporary changes to these Orders since the last amendments were made in January 2016. The purpose of this amendment request is to consolidate these existing changes into amendments.

 

Three other minor changes to the Parish Order are also requested.

 

 

Discussion 1 - Road Traffic (St Helier) (Jersey) Order 1996

 

The Article 68 Notices are as follows.

 

Parish of St.Helier notices: -

 

  1. Cattle Street. Reduction in unloading area and increase in 1 hour paycard area.
  2. Clairvale Road and Brighton Road. Changes to motor cycle parking and visitors parking in a Parish Residents’ Parking Zone.
  3. Don Street. Change paycard space to motorcycle parking spaces.
  4. Wharf Street.  Replacement of disabled parking space with unloading bay, to replace the bay in Conway Street that has been removed as part of the footway improvements.
  5. Columbus Street and Windsor Road.  Re-location of motorcycle parking bay to a new location in Windsor Road.
  6. La Rue de L’Etau.  Restriction on parking in two parking / unloading bays. One bay to be general parking limited to 10 minutes.  One bay to be unloading only, limited to 20 minutes – please see Plan 1 attached to this report.
  7. Great Union Road. Addition of Residents’ parking spaces and motorcycle parking spaces.
  8. Rue de Trachy. Restriction on parking duration to 12 hours maximum in two parking areas.
  9. West Hill. Restriction on parking duration to 3 hours maximum in 3 spaces.
  10. The Parade (Eastern arm). Restriction on parking in echelon spaces to 1 hour maximum.
  11. Vallee des Vaux. Introduction of areas of prohibited waiting plus an area of parking duration of 3 hours maximum.

 

DFI notices: -

 

  1. Mulcaster Street. Evening road closures (at the request of the States of Jersey Police).
  2. Halkett Place. Reduction in paycard parking to accommodate new Al Fresco area outside “The Halkett”.
  3. Charing Cross. Closure of road between Broad Street and Sand Street.

 

Parish / DFI shared notice: -

 

Halkett Street / Bath Street / Beresford Street. Parking, unloading and access changes to control inconsiderate parking in the precinct areas and to provide replacement unloading facilities in Beresford Street.

 

None of the above will lead to any material changes on-street.

 

Other requested minor changes:

 

Establish an unloading bay on the stone paved area on the south side of York Street. This area has been used informally for unloading for many years. Formalising the area via a traffic sign will enable more positive policing – please see Plan 2 attached to this report.

 

Stopford Road. Replace a “Keep Clear” road marking outside No.11 that is no longer required with a Residents’ parking space.

 

Minor discrepancies in the drafting of visitor parking areas in the Parish’s Residents’ Parking Zones have been identified which have led to some difficulties in imposing parking fines.  The proposed draft amendment will remove these discrepancies.

 

 

Discussion 2 - Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002.

 

  1. Halkett Place. Re-location of disabled parking to accommodate new Al Fresco  area outside “The Halkett”.
  2. Wharf Street. Removal of a disabled space from the Order as it has been replaced by an unloading bay.
  3. Grouville, Gorey Village Road. Remove parking space because it was used for the nearby Church, which has now been converted to a private dwelling.
  4. St Saviour, Plat Douet Road. Remove the 4 hour time limit for the space near to No.79 Grasset Park.

 

None of 1 – 3 above will lead to any material changes on-street.

 

 

 

 

 

 

Recommendation

 

The Minister is recommended to approve the proposed amendments to the Road Traffic Orders.
