Public Employees Contributory Retirement Scheme - Membership of the Committee of Management.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

PROPOSITION

THE STATES are asked to decide whether they are of opinion -

to approve, in accordance with Regulation 3(2) of the Public Employees (Contributory Retirement Scheme) (General) (Jersey) Regulations 1989, the appointment of the Committee of Management, for a period of three years commencing 1st January 2007 as follows -

REPORT

The Regulations provide that a Committee of Management will be established which shall have and exercise all such powers, authorities and discretion as are vested in it by the Regulations governing the scheme.

The membership comprises six employer representatives and six member representatives or such greater equal number as may be determined from time to time by agreement between the Human Resources Committee and the representative associations. The total membership is currently seven on each side. Of the employer representatives four are chosen by the Chief Minister whilst the remaining three are chosen by the Treasury and Resources Minister. Nominations for member representatives are determined in a manner which the Chief Minister has agreed with the representative associations. The member representative nominations have been submitted by the Public Employees Pension Scheme Joint Negotiating Group. All employer and member representatives serve in an honorary capacity.

There are no financial or manpower implications for the States arising from this proposition.

Mr John Rosser

Mr Rosser retired from a senior position in the local insurance industry which he held for 15 years, having previously worked in Bristol and London. He spent several years as a council member of the Insurance Institute of Jersey, including a year as President, and several years on the committee of the Jersey Life and Pensions Society, including two years as Chairman. Member of the Social Security Advisory Council.
