Minister's Comments on P.166/2008 Speed Limits: Creation of a Review Working Group.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

TRANSPORT AND TECHNICAL SERVICES  

MINISTER’S COMMENTS ON P166 SPEED LIMITS:  

CREATION OF A REVIEW WORKING GROUP  
 

Purpose of the report  

To seek the Minister’s approval to draft comments on the Report and Proposition lodged by Deputy Gorst entitled ‘Speed Limits: Creation of a Review Working Group’ (P166/2008). 
 

Background  

Deputy Gorst is requesting States approval to the following: 

  1. to establish a Review Working Group to review the implementation, operation and suitability of the current Speed Limits Policy (P.1/2004) as approved by the States on 15 March 2005;

 

(b) to appoint three States Members as members of the Review Working Group of whom at least two, including the Chairman, shall not be Ministers or Assistant Ministers, with the Working Group to receive appropriate assistance from relevant officers; and

 

(c) to present the conclusions of the Review Working Group with any associated recommendations for change to the Assembly before 30 June 2009. 

The debate is scheduled for 02 December 2008. 

As speed limits for the Island’s roads are the responsibility of the Minister for Transport and Technical Services, it would seem appropriate that the Minister presents comments on this proposition. 
 

Discussion  

  1. The Speed Limits Policy was finally approved by the States in March 2005 following an extensive review period and a lodging period of more than a year. This subject is contentious, subjective and, to some extent, emotive and, although the Minister has taken decisions reflecting the approved policy, many requests are refused. In addition, there are parts of the policy which are difficult to define – for example, what is an urban, built up area – which can cause frustration.

 

  1. It would seem appropriate, after more than three years in operation, to review how the current policy is being implemented and to go as far as considering whether the policy is suitable. In this respect, it is recommended that the Minister supports the proposition.

 

  1. However, it is suggested that the composition of the Working Group should include either the Minister or Assistant Minister for Transport and Technical Services on an ex-officio co-opted basis given that s/he has responsibility for speed limits within the Island.

 

  1. A draft comment to be presented to the States as presented in the attached supporting document.

 
 

Recommendation 

The Minister is recommended to approve the draft comment as stated above.
