Road Traffic (Public Parking Places) (Jersey) Order 2006: Amendment: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

DEPARTMENT FOR INFRASTRUCTURE

 

CHANGE OF MAXIMUM STAY PERIOD IN MARTELLO TOWER CAR PARK,

 

GREVE DE LECQ,  ST OUEN

 

 

Purpose of the Report

 

To change the maximum permitted stay in Martello Tower Car Park, Greve de Lecq, St Ouen from the current seven consecutive days to 12 hours in any continuous 24 hour period.

 

 

Discussion

 

A request from the Connétable of St Ouen has been received to change the maximum permitted stay period in Martello Tower Car Park at Greve de Lecq in St Ouen. The Martello Tower Car Park is scheduled in the Road Traffic (Public Parking Places) (Jersey) Order 2006.

 

The Connétable has reported that members of his Honorary Police who carry out policing of this car park are experiencing problems with vehicles being abandoned for long periods of time.  This can have a detrimental effect on the availability of parking spaces during busy periods when large numbers of people wish to visit Greve de Lecq and use the facilities and businesses there.  Changing the maximum stay period would enable the St Ouen Honorary Police to police this car park more effectively.

 

The increased availability of parking spaces would benefit local traders who have businesses at Greve de Lecq, as well as people who wish to visit the beach.

 

Officers of the Department for Infrastructure support the Connétable of St Ouen’s request.

 

The Road Traffic (Public Parking Places) (Jersey) Order 2006 is administered by the Department for Infrastructure.

 

 

Recommendations

 

The Minister is recommended to approve the request from the Connétable of St Ouen to change the maximum stay period in Martello Tower Car Park to a 12 hour in a continuous 24 hour period.
