Information about the publication of Ministerial Decisions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): To agree a budget transfer of revenue of £41,100 for 2006 increasing to £42,100 in 2007 for the transfer of responsibilities for the maintenance of public buildings and markets from Transport and Technical Services to Property Holdings. Also to agree to transfer the unspent balance on the Markets Maintenance capital vote C2668. This was £907,286 on 30th June 2006.
Reason(s) for decision: In June 2005 the States approved the creation of the Property Holdings Department to be responsible for the administration of all States Property. The above transfer is a necessary stage in the creation of this Department.
Action required: To transfer the budgets and balances of the relevant business units and accounts in the Transport and Technical Services Department to the Property Holdings Department, effective from 1st August 2006

Budget Transfer from TTS to Property Holdings.

REPORT TO THE MINISTER FOR TREASURY AND RESOURCES

Purpose of the Report

To seek the approval of the Minister for Treasury and Resources for transfers of budgets from the Transport and Technical Services Department to the Treasury and Resources Department.

Background

In June 2005 the States agreed the creation of a new States Department, Property Holdings Department, to be responsible for the administration of all States property.

The Chief Executive Officer was appointed in September with a small project team and the Department was officially created on the 1st January 2006 taking over responsibility for the Property Services Division of Transport and Technical Services. On 1st August 2006 it is intended that responsibility for maintenance of public buildings and the markets is transferred from Transport and Technical Services to Property Holdings

The detailed revenue budget to be transferred is attached on Schedule A. The summary is shown below. The unspent balance on the Markets’ capital vote C2668 also needs to be transferred. At 30th June 2006 this amounted to £907,286 from an overall allocation of £1,492,000.

Included in the revenue budget are-:

£442,600 for the provision of office cleaning which will be carried out by the Transport and Technical Services Department and recharged to the Property Holdings Department.

£191,800 for the full year cost of caretakeing, office cleaning and weighing services at the Market to be carried out by the Transport and Technical Services Department and recharged.

The budget for the cleaning of public toilets is being retained by Transport and Technical Services Department and that Department will provide the service.

Service level agreements for these areas will be developed to take effect from

1st January 2007.

Recommendation

The Minister for Treasury and Resources is recommended to approve the revenue and capital budget transfers as shown above, from Transport and Technical Services to Treasury and Resources effective on 1st August 2006
