Shadow Chair for Data Protection Authority

The States of Jersey and Guernsey are recruiting a Shadow Chair for the Data Protection Supervisory Authorities of the Channel Islands. The Shadow Chair will help shape the way data protection is regulated in the Channel Islands, and will provide independent advice to the respective States, as well as to the Supervisory Authorities, on exercising their responsibilities under new data protection legislation. The Shadow Chair will be recruited from outside Jersey and Guernsey.

The Channel Islands have committed to enact new Data Protection Laws that provide the same standard of protection for personal data as new EU data protection legislation. This will ensure that personal data can continue to flow freely between the Channel Islands and Europe once the EU General Data Protection Regulation (GDPR) and Law Enforcement Directive come into force in May 2018.

The new legislation will also update the statutory basis for the data protection regulator in the Channel Islands: establishing an independent Supervisory Authority in Jersey and Guernsey. As part of this, strengthened governance arrangements will be put in place to ensure the pan-Island regulator receives, and is supported by, enhanced regulatory oversight and greater independence from government.
 
The Shadow Chair is expected to support the Channel Islands governments and Supervisory Authorities to develop these governance arrangements, including the expected creation of a new board. This meets the commitments made in a report to the States Assembly in June 2016 in Jersey, and Billet D-Etat XXIII in September 2016 in Guernsey.

Jersey’s Assistant Chief Minister, Senator Paul Routier, said “We have been working with Guernsey colleagues to maintain our pan-Island approach and to co-ordinate our development of this enhanced regulatory framework. The Shadow Chair will support the Supervisory Authorities in implementing new governance structures that will ensure the Channel Islands continue to provide the highest level of protection for personal data.”
