About the consultation

The Employment (Jersey) Law 2003 enables the Minister for Social Security to approve codes of practice for the purposes of the Employment Law.
 
The Minister has directed the Employment Forum to consult on three codes of practice that have been updated:
 

Code 1 - Disciplinary and Grievance Practice and Procedures

The code provides practical guidance on grievance and disciplinary procedures and best practice. Following a proposition to the States in November 2011, the Forum reviewed the guidance about employee representatives in formal disciplinary and grievance hearings and recommended changes to paragraphs 45 and 50. The code has also been updated to replace outdated references.
 

Code 2 - Uninterrupted Rest Days

The code provides guidance on what counts as ‘interrupted’ rest for the purpose of statutory rest day entitlement. The purpose is to enable employers to make arrangements that meet the statutory requirement to provide uninterrupted rest days where an employee spends time on-call or on standby. The code has been updated by replacing outdated references.
 

Code 3 - Therapeutic Work

The code provides guidance to determine whether the relationship between two parties is that of employee and employer, or client and therapeutic work provider. The code has been updated by replacing outdated references, as well as removing repetition.
 
We're seeking the views of stakeholders and will consider any comments received before making a recommendation to the Minister.
