Employment protection for Armed Forces Reservists

About the consultation

The Minister for Home Affairs has asked the Minister for Social Security to consider protecting Jersey reservists in the armed forces so that they have equivalent employment protection to UK reservists when they are mobilised on active service.

The Ministry of Defence intends to increase the percentage of reservists compared with regular armed forces which means that there is likely to be a greater call on the services of reservists in the future. In addition, with the armed forces deployed in several conflict zones, the likelihood of a member of the Jersey Field Squadron being requested to mobilise on active service is thought to be high.

The Minister for Social Security asked the Employment Forum to consider if the Employment Law should be amended to give certain employment protections to reservists.

The Employment Forum's consultation paper includes details of the current position in Jersey and the UK, explains what the terminology means and provides a survey.

What we want you to comment on

We would like to hear your views about whether reservists should have specific employment rights and if so, whether this should include, for example:
  • the right to return to the same job at work after returning from being mobilised on active service
  • protection against being dismissed on grounds of being a reservist

Survey

You can complete the survey if you are an Armed Forces Reservist, an employer, an employee, a trade union, an employers' association, an advisory body or any other interested party.
