Re Anti Money Laundering Legislation

Would you kindly advise me of how many people have been charged with 'Tipping Off' offences and how many have been successfully convicted?

Response

The offence of tipping off was created under Article 35 of the Proceeds of Crime (Jersey) Law 1999.

Article 35 Tipping off and interference with material

(1)     Paragraph (2) applies where a person knows or suspects that the Attorney General or any police officer is acting or proposing to act in connection with an investigation that is being or is about to be conducted into money laundering.

(2)     It is an offence for the person –

(a)     to disclose to another person any information relating to the investigation; or

(b)     to interfere with material which is likely to be relevant to the investigation.

There have been no charges or convictions recorded in Jersey for this offence to date.
