After a driver has had their PSV Taxi-Cab Badge removed by DVS / The Minister as not "fit and proper" to drive a taxi please advise:

A

How long a driver has to wait until applying for another Badge?

B

Is there any specific process for assessing the driver to now be "fit and proper"?

A

A driver whose badge has been revoked by the Minister can apply at any time for a badge in respect of a public service vehicle, however the onus would be on the applicant to prove that they are fit and proper to be a public service vehicle driver.

B

There is no test to determine if an applicant for a PSV Licence is “fit and proper” or an applicant for a PSV Badge is “fit”. Each application would be considered on its own merit and if relevant taking into account the reason(s) why an applicant’s licence may have been revoked in the first place. Evidence provided should take into consideration any potential impact on members of the public, with the public interest being paramount.
