I would like confirmation of the number of vehicles registered in Jersey satisfying the following criteria: 

• manufactured by (a) Volkswagen, (b) Audi, (c) Seat, (d) Skoda, (e) Renault, (f) Chrysler, (g) Land Rover, (h) BMW (i) Mini Cooper (j) Skoda (k) Citroen (l) Mercedes (m) Vauxhall (n) Fiat (o) Nissan (p) Ford (q) Peugeot (r) Volvo (s) Jaguar (t) Porsche (u) Kia and with
• diesel engine
• made between 2007 and 2018

The information you have requested is partially exempt under Article 23 (Accessible by other means) and Article 36 (Future Publication) of the Freedom of Information (Jersey) Law 2011.

The Government of Jersey has committed to publish vehicle registration details quarterly on open data:

Once downloaded, the whole spreadsheet can be filtered to allow the extraction of the specific information required e.g., per manufacturer and fuel type.

It should be noted that diesel is recorded as heavy oil in the DVS registration system.

DVS does not routinely record the manufacture dates for vehicles unless this has been provided for older vehicles at the time of registration, therefore, this information is not held, and Article 10 of the Freedom of Information (Jersey) Law 2011 applies.

Registration details up to 30 September are due to be published in October 2022 and access to this and any future updates will be available on the open data website by using the search term 'Registered Vehicles'.

Article 10 - Obligation of scheduled public authority to confirm or deny holding Information 

(1) Subject to paragraph (2), if –

(a) a person makes a request for information to a scheduled public authority; and

(b) the authority does not hold the information, it must inform the applicant accordingly.

Article 23 - Information accessible to applicant by other means

(1) Information is absolutely exempt information if it is reasonably available to the applicant, otherwise than under this Law, whether or not free of charge.

(2) A scheduled public authority that refuses an application for information on this ground must make reasonable efforts to inform the applicant where the applicant may obtain the information.

Article 36 - Information intended for future publication

(1) Information is qualified exempt information if, at the time when the request for the information is made, the information is being held by a public authority with a view to its being published within 12 weeks of the date of the request.

(2) A scheduled public authority that refuses an application for information on this ground must make reasonable efforts to inform the applicant –

(a) of the date when the information will be published;

(b) of the manner in which it will be published; and

(c) by whom it will be published.

(3) In this Article, "published" means published –

(a) by a public authority; or

(b) by any other person.

Public Interest Test

Article 36 is a qualified exemption, which means that a public interest test has to be undertaken to examine the circumstances of the case and decide whether, on balance, the public interest in maintaining the exemption outweighs the public interest in disclosing the information.

• It is intended to publish registration data within 12 weeks of the receipt of this request on www.opendata.gov.je. The information is currently being collated prior to publication and therefore it is not possible to release it at this stage.
